The Small Business Procurement and Contract Act encourages the
participation of certain small businesses
disabled veteran business enterprises that are certified by the
Department of General Services in state contracts.
This bill would require an applicant for certification by
a disabled veteran business enterprise to file with
the department to file a specified federal
tax form under certain circumstances .
Vote: majority. Appropriation: no. Fiscal committee: yes.
State-mandated local program: no.
THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:
SECTION 1. Section 14840 is added to the Government Code, to read:
14840. In the process of certifying and determining the
eligibility of a small business, microbusiness, or disabled veteran
business enterprise under this chapter, the department shall require
the applicant to file a completed Form 4506-T from the federal
Department of the Treasury, Internal Revenue Service. The department
shall not certify any business without the completed Form 4506-T from
the applicant.
14840. The department shall require a disabled veteran
business enterprise to file with the department a completed Form
4506-T from the federal Department of the Treasury, Internal Revenue
Service, also known as a Request for Transcript of Tax Return, in
both of the following circumstances:
(a) The department receives a complaint regarding the disabled
veteran business enterprise.
(b) During any audit of the disabled veteran business enterprise.
