An act to add Section 3001.1 to the Penal Code, relating to
inmates.
LEGISLATIVE COUNSEL'S DIGEST
AB 2262, as amended, Bass. Inmates: identification cards.
Existing law provides that after inmates are released from the
Department of Corrections and Rehabilitation, they are generally
placed on parole, as specified.
This bill would require the Department of Corrections and
Rehabilitation to establish a pilot program at Folsom State Prison,
the R.J. Donovan Correctional Facility, the California Institution
for Women, and the Preston Youth Correctional Facility, for the
purpose of providing each inmate at those facilities, prior to his or
her release, a valid California identification card, as defined,
issued by the Department of Motor Vehicles (DMV).
This bill would require the Department of Corrections and
Rehabilitation, in collaboration with the DMV, to allow the DMV to
make biannual visits to the department's facilities to provide
state-issued identification cards to inmates upon their release and
to inmates who are eligible to be released or released on parole
within 6 months.
This bill would specify the department's duties in providing and
obtaining the information necessary for eligible inmates to obtain
identification cards.
This bill would make its provisions operative on January 1, 2012.
This bill would require the Department of Corrections and
Rehabilitation to provide each inmate, prior to his or her release,
with the inmate's Department of Motor Vehicles-issued identification
card number or driver's license number, if the inmate has an
identification card number or driver's license number, and if the
Department of Corrections and Rehabilitation possesses it.
Vote: majority. Appropriation: no. Fiscal committee: yes.

THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:
SECTION 1. Section 3001.1 is added to the Penal Code, to read:
3001.1. (a) The Department of Corrections and Rehabilitation
shall establish a pilot program at Folsom State Prison, the R.J.
Donovan Correctional Facility, the California Institution for Women,
and the Preston Youth Correctional Facility, for the purpose of
providing each inmate at those facilities, prior to his or her
release, with a valid California identification card issued by the
Department of Motor Vehicles. (b) The department,
in collaboration with the Department of Motor Vehicles (DMV), shall
allow the DMV to make biannual visits to the department's facilities
at the prisons specified in subdivision (a) for the purpose of
providing state-issued identification cards to inmates upon their
release and to inmates who are eligible to be released or released on
parole within six months. (c) The department
shall verify inmate eligibility for the identification card by
obtaining the inmate's birth date and legal presence information
through the inmate's file. (d) Identification
cards shall be issued pursuant to subdivision (a) of Section 13005 of
the Vehicle Code. (e) All identification cards
will be subject to Section 13004 of the Vehicle Code.
(f) This section shall become operative on January 1, 2012.
3001.1. The Department of Corrections and Rehabilitation shall
provide each inmate, prior to his or her release, with the inmate's
California identification card number or California driver's license
number issued by the Department of Motor Vehicles if all of the
following apply:
(a) The Department of Motor Vehicles has issued that inmate a
California identification card number or California driver's license
number.
(b) The Department of Corrections and Rehabilitation possesses the
inmate's California identification card number or California driver'
s license number.
