To the Members of the California State Assembly:

I am returning Assembly Bill 2338 without my signature.

This bill would allow off-highway vehicles to operate on certain
roads in Inyo County unless the California Highway Patrol (CHP)
Commissioner finds that designating a highway, or the portion of a
highway, would create a potential traffic safety hazard.

This bill could expose the state to liability issues if the CHP
allows joint use by off-highway vehicles and vehicles on roads in
Inyo County and an accident occurs.  This liability could result in
significant costs to the state.

For this reason I am unable to sign this bill.
