          SUBJECT  :  Board of Governors of the California Community  
          Colleges:  consultation process.

           SUMMARY  :  Would require the California Community Colleges (CCC)  
          Board of Governors (BOG) to include two classified employees of  
          CCC, one from each of the two statewide collective bargaining  
          organizations that represent classified employees of CCC, in the  
          membership of the Consultation Council (Council) established by  
          BOG.

           EXISTING LAW  requires BOG to establish and carry out a process  
          for consultation with institutional representatives of CCC  
          districts to ensure their participation in the development and  
          review of policy proposals.  Requires the process to ensure CCC  
          organizations and interested individuals and parties have an  
          opportunity to review and comment on proposed policies before  
          those policies are adopted by BOG.  Designates the exclusive  
          representative of the classified employees as the sole party  
          responsible for making appointments to community college shared  
          governance committees.

           FISCAL EFFECT  :  Unknown

           COMMENTS  :   Purpose of this bill  :  According to the author, the  
          present Council disproportionately represents CCC faculty and  
          administrators. The author argues that legislation is necessary  
          to include additional membership that represents classified  
          employees.  The author notes that this bill is intended to  
          create parity in the representation of classified employees, in  
          order to ensure that the development and review of policy  
          proposals affecting CCC is adequately informed by its respective  
          constituencies.

           Background  :  As noted above, California law requires BOG to  
          establish a consultation process.  Through Standing Orders, BOG  
          established the basic structure of the consultation process and  
          required the CCC Chancellor to adopt Executive Orders to  
          implement the consultation process, including convening and  
          regularly meeting with the Council to discuss various policy

          matters.  The CCC Chancellor's Executive Orders establish the  
          membership of the Council, the responsibilities of Council  
          members and the Chancellor's staff, the Council meetings  
          process, the Council participant training, and the availability  
          of consultation materials.

           Council Membership  :  The CCC Chancellor's Executive Orders  
          outline the membership of the Council, as follows:

          Institutional Representatives:
          2 CCC district chief executive officers, selected by the Chief  
          Executive Officers of the CCC 
          2 CCC faculty members, selected by The Academic Senate 
          2 students, selected by the Student Senate 
          1 chief business officer, selected by the Association of Chief  
          Business Officers 
          1 chief student services officer, selected by the CCC Chief  
          Student Services Administrators 
          1 chief instructional officer, selected by the Chief  
          Instructional Officers of CCC 
          1 chief human resources officer, selected by Chief Human  
          Resources Officer

          Organizational Representatives: 
          1 representative of the Association of CCC Administrators 
          1 representative of the California Student Association of CCC
          1 representative of the CCC Association/California Teachers  
          Association 
          1 representative of the CCC/California Federation of Teachers 
          1 representative of the CCC Independents 
          1 representative of the Community College League of California 
          1 representative of the California School Employees Association 
          1 representative of the Faculty Association of CCC

          Additionally, the Executive Orders provide that, to further  
          inform and facilitate discussion, the CCC Chancellor may invite  
          other organizations, individuals, and staff to participate in  
          selected discussions of the Council.

           CCC employees  :  Based on CCC Chancellor's Office data,  
          classified employees represented approximately 31% of CCC  
          district employees in 2008; with 1554 Classified Administrators,  
          2136 Classified Professional, and 20,035 Classified Support  
          employees.  In 2008, just over 67% of CCC employees were faculty  
          (18,200 tenured/tenure track faculty, and 45,257

          part-time/temporary faculty), and Educational Administrators,  
          with 2051 employees, were approximately 2.2% of CCC employees.  
           
          Issues to Consider  :  

           1)This bill would require that the Council, which is not defined  
            in state law, include two classified employee representatives  
            in its membership.  The Committee may wish to consider whether  
            it is appropriate to establish a requirement in state law that  
            speaks to the representation of classified employees on the  
            Council when neither the Council nor its membership are  
            currently defined in state law.

          2)The Committee may wish to consider if legislation is  
            necessary.  As noted previously in this analysis, the CCC  
            Chancellor's Executive Orders outline the membership of the  
            Council.  The CCC Chancellor could revise the Council  
            membership outlined in the Executive Orders.  It is unclear if  
            the author and sponsors have approached the CCC Chancellor to  
            request a revision of the Council membership to include  
            additional representation for classified employees.
