SUMMARY : Adds environmental documentation to the list of costs
to be determined by an assessment of affordability using
Department of Public Health (DPH) criteria.
The Senate amendments delete the Assembly version of the bill,
and instead add environmental documentation to the list of costs
to be determined by an assessment of affordability using DPH
criteria.
EXISTING LAW :
Under the Safe Drinking Water State Revolving Fund Law of 1997:
1) Sets the maximum amount of a planning grant for a
participating public water system's costs for planning,
engineering studies, environmental documentation, and design
of a project at no more than $500,000. Maximum amounts are
also set for construction grants.
2) Requires total funding for planning, engineering studies,
project design, and construction costs, whether in the form
of a loan or grant, to be determined by an assessment of
affordability using criteria established by DPH.
AS PASSED BY THE ASSEMBLY , this bill established legislative
intent to encourage the Department of Water Resources, if it
elects to expend integrated regional water management funds to
implement a pilot program for disadvantaged community
assistance, to require a recipient of funds under the pilot
program to conduct specified activities.

FISCAL EFFECT : According to the Senate Appropriations
Committee, this bill is subject to Senate Rule 28.8.
COMMENTS : AB 1438 (Conway) Chapter 531, Statutes of 2009,
among other requirements, set a limit of $500,000 for planning,
engineering studies, environmental documentation, and design of
a single project. Current law also requires total funding for
planning, engineering studies, project design, and construction
costs, whether in the form of a loan or grant, to be determined
by an assessment of affordability using criteria established by
DPH. AB 1438, failed to include "environmental documentation"
in the affordability assessment requirement. AB 2669 corrects
this oversight.
This subject matter was not heard in the Assembly.
