SUMMARY
This bill requires, notwithstanding any other provision of law,
Regional Centers to follow current law contained in the
Lanterman Act and the California Early Intervention Services Act
(CEISA) when developing, reviewing, or modifying a consumer's
individual program plan (IPP) or individualized family service
plan (IFSP) .
FISCAL EFFECT
No direct fiscal impact to Regional Centers or the California
Department of Developmental Services (DDS). This bill codifies
current practice by referring to current law requirements under
the Lanterman Act and the California Early Intervention Services
Act.
COMMENTS
1)Rationale . This bill is sponsored by the ARC of California to
ensure planning and service provision for individuals with
developmental disabilities follows California law. According
to the author and sponsor this bill helps address concerns
that budget reductions in recent years have resulted in
instances of RC failing to following current law.
2)Background . The Lanterman Developmental Disabilities Act
requires persons with developmental disabilities, regardless
of age or degree of disability, to have access to services to
meet their needs in the least restrictive setting. DDS
contracts with 21 RC to provide community-based services for
200,000 developmentally disabled consumers. The Lanterman Act

requires an IPP to be developed for individuals three years of
age and older who are eligible for RC services.
The DDS, together with the California Department of Education,
administers the federally funded Early Start Program. The
Program provides a range of health and social services to
children up to three years of age who meet specified
eligibility criteria including a developmental delay or a
number of risk factors likely to result in a developmental
delay, including preterm birth, low birth weight, delivery
complications, and prenatal exposure to alcohol or drugs.
