CONCURRENCE IN SENATE AMENDMENTS

SUBJECT : Housing and community development: housing omnibus
bill.
SUMMARY : Makes technical and non-controversial changes to
various sections of the law dealing with housing.
The Senate amendments :
1)Require the California Housing Finance Agency (CalHFA) to
provide a report to the Legislature by December 31, 2011, and
December 31, 2012, regarding the status of the state's program
under the federal Housing Finance Agencies Innovation Fund for
the Hardest-Hit Housing Markets program.
2)Require redevelopment agencies to post their implementation
plans online and to include in the database of affordable
units they are already required to post online the date that
the database was last updated and whether occupancy of each
unit is restricted to a special population (e.g., seniors).
3)Correct anachronistic references to the now-defunct Commission
on Housing and Community Development in the Factory-Built
Housing Law.
4)Allow the Department of Housing and Community Development
(HCD) to hold informal hearings under the Factory-Built
Housing Law, consistent with the Administrative Procedures
Act.
5)Update terminology related to mobilehomes and manufactured
homes and corrects cross-references to the Code of Federal
Regulations in the Business and Professions Code.

6)Replace the term "warehouseman's lien" with "warehouse lien"
in the Mobilehome Residency Law, consistent with terminology
used elsewhere in statute.
7)Update a number of phrases and references in the Building
Standards Law that need to be changed to reflect current codes
and common terminology.
8)Includes language to avoid chaptering conflicts with SB 812
and AB 2536.
AS PASSED BY THE ASSEMBLY , this bill:
1)Corrected a drafting error in housing element law that
incorrectly refers to the planning period of the general plan
rather the planning period of the housing element and includes
uncodified language explaining the reason for the amendment.
2)Exempted properties that house victims of domestic violence
shelters from the requirement that a property's address be
listed on the Notice of Affordability Restrictions that is
required to be recorded under redevelopment law.
3)Allowed the guidelines for the Affordable Housing Revolving
Development and Acquisition Program to remain in force for the
duration of the initial loans and only requires regulations
for future requests for qualifications (RFQs) funded with loan
repayments.
4)Requires the Bureau of State Audits (BSA) to conduct periodic
audits of all programs funded under Proposition 1C, the
Housing and Emergency Shelter Act of 2006. Current law
already requires periodic audits of most programs funded by
Proposition 1C, but omits the Infill Infrastructure Grant
Program and the Transit Oriented Development Program.
5)Corrected numerous statutory cross-references, fixes numbering
errors, and repeals several outdated provisions of code.
FISCAL EFFECT : According to the Assembly Appropriations
Committee, costs associated with this bill are minor and would
be absorbable within existing resources.

COMMENTS : The Assembly Committee on Housing and Community
Development is authoring this year's housing omnibus bill as a
cost-effective way of making a number of minor,
non-controversial changes to statute at one time. There is no
known opposition to any of the items in the bill.
