SUBJECT : Permits: Restricted Animals
SUMMARY : Repeals an obsolete section of the Fish and Game Code
relating to permits for certain restricted animals possessed
prior to 1975. Specifically, this bill repeals a narrow
exception to existing law, which otherwise prohibits the
possession of certain restricted animals, allowing such animals
to be possessed under permit if the owner legally acquired and
possessed the animal prior to 1975.
EXISTING LAW :
1)Makes it unlawful to import, transport, possess, or release
restricted animals without a permit.
2)Authorizes persons to possess under permit certain restricted
animals which are prohibited from being imported, transported,
possessed or released alive solely because of concern for the
welfare of the animal, if the owner can demonstrate the animal
was legally acquired and possessed in the state prior to 1975.
FISCAL EFFECT : Unknown
COMMENTS : This bill deletes an obsolete section of the Fish
and Game Code. There are no known permits still in effect under
this section, which applies only to permits for a certain
narrowly defined class of restricted animals that were legally
acquired and possessed prior to 1975. Continuing to allow this
section to remain on the books creates potential confusion
regarding the availability of such permits. This bill is
intended as a technical code cleanup measure.
