SUBJECT
California Emergency Management Agency
DESCRIPTION
AB 2791 makes various statutory and technical changes to
reflect the merger of the former Office of Emergency
Services (OES) and the former Office of Homeland Security
(OHS) into the California Emergency Management Agency
(CalEMA) that took effect January 1, 2009.
EXISTING LAW
Existing law creates CalEMA and requires it to perform a
variety of duties with respect to specified emergency
preparedness, mitigation, and response activities in the
state.
Prior to the creation of the CalEMA, these activities were
the responsibility of the Governor's OES and the OHS. The
Budget Act of 2003 eliminated the Office of Criminal
Justice Planning (OCJP) and its responsibilities for
administering a variety of planning, training, education,
and crime suppression and mitigation programs ultimately
were assigned to OES.
BACKGROUND
Purpose of AB 2791: When OES and OHS were merged to become
CalEMA in January 2009, various codes sections were not
updated to reflect this change in responsibility.
Additionally, when the former OCJP was abolished, its
responsibilities were redirected to OES, now CalEMA.

Existing law does not clearly place these programs and
functions within CalEMA. This measure also eliminates the
statute for 13 different reports that CalEMA is required to
produce and instead requires the information to be included
in CalEMA's annual report.
Prior Legislation: AB 38 (Nava) Chapter 372, Statutes of
2008, merged OES and OHS to create CalEMA.
