SUBJECT : California Emergency Management Agency

DIGEST : This bill makes various statutory and technical
changes to reflect the merger of the former Office of
Emergency Services and the former Office of Homeland
Security into the California Emergency Management Agency
that took effect January 1, 2009.
Senate Floor Amendments of 8/18/20 and 8/20/10 are intended
to address numerous minor drafting errors and code
maintenance changes. Additionally, these amendments are
intended to avoid conflict with two bills enacted earlier
this year [AB 1887 (Villines), Chapter 32, 2010, relating
to the Major Risk Medical Insurance Program and AB 12 X8

(Assembly Budget Committee), Chapter 8, Statutes of
2009-10, Eighth Extraordinary Session, relating to port and
maritime security funds] as well as chaptering issues with
two bills pending in the current session [AB 2408 (Smyth)
relating to the Governor's Reorganization Plan No. 1 of
2009 which consolidated state information technology
functions under the Office of the State Chief Information
Officer, and SB 1254 (Leno) relating to contractors and
workers' compensation insurance coverage].
ANALYSIS : Existing law creates California Emergency
Management Agency (CalEMA) and requires it to perform a
variety of duties with respect to specified emergency
preparedness, mitigation, and response activities in the
state.
Prior to the creation of the CalEMA, these activities were
the responsibility of the Governor's Office of Emergency
Services (OES) and the Office of Homeland Security (OHS).
The Budget Act of 2003 eliminated the Office of Criminal
Justice Planning (OCJP) and its responsibilities for
administering a variety of planning, training, education,
and crime suppression and mitigation programs ultimately
were assigned to OES.
Comments
When OES and OHS were merged to become CalEMA in January
2009, various codes sections were not updated to reflect
this change in responsibility. Additionally, when the
former OCJP was abolished, its responsibilities were
redirected to OES, now CalEMA. Existing law does not
clearly place these programs and functions within CalEMA.
This bill also eliminates the statute for 13 different
reports that CalEMA is required to produce and instead
requires the information to be included in CalEMA's annual
report.
