          CONCURRENCE IN SENATE AMENDMENTS

           SUMMARY  :  Makes various statutory and technical changes to  
          reflect the merger of the former Office of Emergency Services  
          and the former Office of Homeland Security into the California  
          Emergency Management Agency in January 1, 2009.   

           The Senate amendments  make relating technical and conforming  
          changes to avoid chaptering issues.

           EXISTING LAW  :
           
          1)Merges the Office of Emergency Services and the Office of  
            Homeland Security to establish the California Emergency  
            Management Agency.

          2)Requires the California Emergency Management Agency to be  
            responsible for the state's emergency and disaster response  
            services, and requires state entities to cooperate              
               with the California Emergency Management Agency in carrying  
            out its duties.
           
           AS PASSED BY THE ASSEMBLY  , this bill makes various statutory and  
          technical changes to reflect the merger of the former Office of  
          Emergency Services and the former Office of Homeland Security  
          into the California Emergency Management Agency.
           
          FISCAL EFFECT  :  According to the Senate Appropriations  
          Committee, pursuant to Senate Rule 28.8, negligible state costs.
           
           COMMENTS  :  This bill, sponsored by the California Emergency  
          Management Agency, seeks to clean up several technical changes  
          to accurately reflect the merger of the former Office of  
          Emergency Services and the former Office of Homeland Security  
          into the California Emergency Management Agency, a cabinet-level

          agency.  In addition, this bill delineates statutory authority  
          for administration of the programs and functions formerly nested  
          under the now-defunct Office of Criminal Justice Planning.

          Additionally, the Senate amendments are intended to avoid  
          chaptering problems with the following bills:

          1)AB 1887 (Villines) Chapter 32, Statutes of 2010, relating to  
            the Major Risk Medical Insurance Program.

          2)AB 12 X8 (Budget Committee) Chapter 8, Statutes of 2009-10  
            Eighth Extraordinary Session, relating to port and maritime  
            security funds.

          3)AB 2408 (Smyth) of the current session, relating to codifying  
            the Governor's Reorganization Plan No.1 of 2009 which  
            consolidated state information technology functions under the  
            Office of the State Chief Information Officer.

          4)SB 1254 (Leno) of the current session, relating to the  
            Contractors State Licensing Board law enforcement  
            authorization.  

          This bill, as amended in the Senate is consistent with Assembly  
          actions.
