BILL SUMMARY: SB 190 would require the California Department of
Public Health (CDPH) to adopt regulations establishing
definitions and standards of identity for 100 percent
pomegranate juice in consultation with interested stakeholders
by July 1, 2011.

STAFF COMMENTS:
Existing law provides that all food labeling regulations adopted
pursuant to the Federal Food, Drug, and Cosmetic Act constitute
California's food labeling regulations.
Existing law, the Sherman Food, Drug, and Cosmetic Law, provides
that if a food purports to be a beverage containing vegetable or
fruit juice, a statement must appear on the information panel
that states the total percentage of fruit or vegetable juice
contained in the food. It is a misdemeanor to misbrand any food.
By July 1, 2011, this bill would require the CDPH to promulgate
regulations that would establish definitions and standards of
identity for 100 percent pomegranate juice in consultation with
interested parties. To implement this bill, the CDPH would need
a staff person to promulgate regulations for about two years at
an estimated cost of $90,000 in FY 2009-2010 and FY 2010-2011.
This bill would provide that moneys deposited into the Food and
Safety Fund on or after January 1, 2010, be made available to
fund the development and adoption of regulations pursuant to
these provisions.
