   An act to add Section 17075.20 to the Education Code, relating to
school facilities.


	LEGISLATIVE COUNSEL'S DIGEST


   SB 305, as amended, Corbett. School facilities: construction:
seismic mitigation. 
   The Leroy F. Greene School Facilities Act of 1998 establishes a
school facilities construction and modernization program that
requires the State Allocation Board to provide state per-pupil
funding to applicant school districts. The act authorizes a school
district that meets specified characteristics established pursuant to
regulations to receive financial hardship assistance for school
facility construction and modernization in cases of extraordinary
circumstances. Extraordinary circumstances may include the need to
repair, reconstruct, or replace the most vulnerable school facilities
that are identified as Category 2 buildings and determined by the
department to pose an unacceptable risk of injury to its occupants in
the event of a seismic event.  
   Existing law requires the Department of General Services, in
consultation with the Seismic Safety Commission, to conduct an
inventory of public school buildings that are concrete tilt-up school
buildings and school buildings with nonwood frame walls that do not
meet specified standards. The Kindergarten-University Public
Education Facilities Bond Act of 2006 makes available up to $199.5
million for the purposes of seismic repair, reconstruction, or
replacement pursuant to the Hardship Assistance Program of the Leroy
F. Greene School Facilities Act of 1998. 
   This bill would  define "most vulnerable Category 2
building" for purposes of the above provisions   require
the Office of the State Architect, within its existing resources, to
update the seismic safety inventory of school buildings and related
report to more accurately identify building deficiencies in school
facilities currently being used for pub   lic school
purposes. The bill would require the State Allocation Board to use
the information from this updated inventory and report to inform the
development of eligibility criteria for the Seismic Mitigation
Program, as defined  .

THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:

  SECTION 1.  Section 17075.20 is added to the Education Code, to
read: 
   17075.20.  For purposes of subdivision (a) of Section 17075.10,
"most vulnerable Category 2 building" means a building that meets all
of the following criteria:
   (a)  The building is located where the short period spectral
acceleration is 1.50g or more based on the 2002 United States
Geological Survey National Seismic Hazard Maps adjusted for site
class factors.
   (b) The building is designed for occupancy by pupils and staff.
   (c) The building type is either C1-Concrete Moment Frame,
PC1A-Precast/Tilt-up Shear Wall with Flexible Roof, PC2-Precast
Concrete Frame and Roofs with Concrete Shear Walls, or
URM-Unreinforced Masonry Bearing Wall.
   (d) A structural engineer provides a structural report that
demonstrates the lateral force-resisting system of the building does
not meet collapse prevention performance objectives and that includes
the specific deficiencies and reasoning for concluding that the
building has potential for catastrophic collapse. 
    17075.20.   The Office of the State Architect, within
its existing resources, shall update the inventory and report
prepared pursuant to Section 17317 to more accurately identify
building deficiencies in facilities currently being used for public
school purposes. The board shall use the information from this
updated inventory and report to inform the development of eligibility
criteria for the Seismic Mitigation Program. For purposes of this
article, "Seismic Mitigation Program" means funding made available
for seismic repair, reconstruction, or replacement under paragraph
(1) of subdivision (a) of Section 101012.
