          SUBJECT  :  Resources:  California Pollution Control Financing  
          Authority:  public lands:  solid waste diversion

           SUMMARY  :  Makes various technical, non-controversial changes to  
          the various statutes under the jurisdiction of the Senate  
          Environmental Quality Committee.

           EXISTING LAW  : 

          1) Establishes the California Pollution Control Financing  
             Authority with specified powers and duties, and authorizes  
             the authority to approve financing for projects or pollution  
             control facilities to prevent or reduce environmental  
             pollution.

          2) Establishes the California Integrated Waste Management Board  
             with specified powers and duties over solid waste management.  


          3) Establishes the State Lands Commission with specified powers  
             and duties over the management of state lands including the  
             power to apply to the United States Department of the  
             Interior for patents to the numbered school sections in  
             place, which have not been patented by the state.

           FISCAL EFFECT  :  Unknown. 

           COMMENTS  :   

           1)Purpose of Bill  .  This is the Senate Environmental Quality  
            Committee's omnibus measure.  It contains provisions to  
            update, clarify and make non-controversial changes to various  
            programs to increase effective program implementation.

           2)The California Pollution Control Financing Authority (CPCFA).    
            Within the State Treasurer's Office, CPCFA provides low-cost

            innovative financing to California businesses. As a "conduit  
            issuer" of tax-exempt private activity bonds, CPCFA is able to  
            facilitate low cost financing to qualified waste and recycling  
            projects. Other projects to control pollution can qualify for  
            tax-exempt financing as allowed by federal tax law. Examples  
            of recent assistance include projects to purchase clean-air  
            vehicles by waste companies, recycle used oil, and develop  
            construction and demolition debris recycling programs. CPCFA  
            works with participating financial institutions to assist  
            small business with loans up to $1.5 million. CPCFA also  
            assists with the clean-up of contaminated sites through a $60  
            million grant and loan program and a site-assessment loan  
            program. The codes governing the CPCFA have not been updated  
            since 1975.  SB 832 conforms and updates the governing code to  
            reflect changes in business practices, program updates, and  
            federal tax law. 

           3)California Integrated Waste Management Board.   Corrects a  
            drafting error in SB 1016 (Wiggins), Chapter 343, Statutes of  
            2008 by replacing the term "city and county" with  
            "jurisdiction".

           4)State Lands Commission.   This bill makes a technical change  
            related to school lands and patents.

           5)Urgency.   This bill contains an urgency clause.
