SUBJECT : Public Safety Budget Trailer Bill

DIGEST : Assembly Amendments delete the Senate version of
the bill which expressed the intent of the Legislature to
enact statutory changes relating to the Budget Act of 2010,
and add the current content relating to Public Safety.
This bill is now the General Government Budget Trailer Bill
which contains provisions necessary to implement the
2010-11 Budget.
ANALYSIS : This is the Public Safety Budget Trailer Bill.
It contains provisions necessary to implement the 2010-11
Budget, including these key changes:
1. Design-Build Authority for Local Projects . Permits
local governments to use design-build process in the
construction of jail and juvenile justice rehabilitation
facility projects authorized by AB 900 (Solorio),

Chapter 7, Statutes of 2007 and SB 81 (Senate Budget and
Fiscal Review Committee), Chapter 175, Statutes of 2007,
respectively.
2. Corrections Annual Report . Requires California
Department of Corrections and Rehabilitation (CDCR) to
provide the Legislature with an annual report on its
operations and performance related to each of its
budgeted programs.
3. Utilization Management . Requires CDCR to maintain a
statewide utilization management program to contain
costs associated with inmate health care services. The
bill also requires CDCR to establish annual performance
objectives and report to the Legislature on its ability
to achieve those objectives.
4. Inmate Pharmacy Services . Authorizes CDCR to maintain a
comprehensive pharmacy services program for state
prisons that is cost-effective and efficient. Further
authorizes creation of a centralized pharmacy
distribution center to provide more cost-efficient
purchasing, inventory control, and distribution of
medications. Requires the CDCR to establish annual
performance objectives and report to the Legislature on
its ability to achieve those objectives.
5. Licensure Extension . Grants the CDCR Authority to
provide one-year extensions for prison health care
workers to acquire their state license if there are
extenuating circumstances. Authority is consistent with
other state departments.
6. Federal Reimbursements . Requires counties electing to
participate in Coverage Expansion and Enrollment
Demonstration (CEED) projects to enroll Medi-Cal
eligible state inmates and parolees. This will allow
counties to achieve federal reimbursements for inpatient
hospital services provided to inmates and for mental
health services provided to parolees. Currently, these
costs are paid for out of the state General Fund.
Additionally, the bill allows participating counties to
seek federal reimbursement for Medi-Cal eligible jail
inmates, costs that are currently paid for from county

funds.
7. AB 900 General Fund Appropriation - Allowable Uses . AB
900, (Solorio), Chapter 7, Statutes of 2007, provides a
one-time $300 million General Fund appropriation for
prison facility infrastructure repair and expansion.
This bill allows these funds to also be used for two
additional purposes: (a) site evaluations for state
reentry facilities and (b) prison dental facility
modifications.
8. Juvenile Parole Realignment . Requires that on a
prospective basis, county probation departments will be
responsible for the supervision of offenders released
from state juvenile facilities. Further requires that
courts, rather than the Juvenile Parole Board, determine
the terms and conditions of supervision, as well as make
revocation decisions when these offenders violate those
terms and conditions. Establishes a formula that
provides county probation departments with $15,000
annually for each juvenile offender on their caseload
under this realignment, as well as $115,000 annually for
each of these offenders held in a local juvenile
facility. Changes are estimated to save the state $5
million in 2010-11.
9. Local Juvenile Justice Rehabilitation Facilities -
Lease-Revenue Authority . Increases from $100 million to
$300 million the one-time appropriation established in
SB 81 (Senate Budget and Fiscal Review Committee),
Chapter 175, Statutes of 2007 and provides to counties
for the purpose constructing and renovating local
juvenile justice rehabilitation facilities.
