An act to amend Section 30915 of, and to add
Section 30914.2 to , the Streets and Highways
Code, relating to transportation.

SB 1061, as amended, Hancock. San Francisco-Oakland Bay Bridge:
capital projects.
Existing law specifies the respective powers and duties of the
Department of Transportation, the Metropolitan Transportation
Commission, and the Bay Area Toll Authority relative to the
state-owned toll bridges in the Bay Area. Existing law specifies
the major capital projects on the bridges and
other expenditures that may be funded from toll revenues.
Existing law provides that the authority may increase the toll rates
to provide funds for various purposes, including the planning,
design, construction, operation, maintenance, repair, replacement,
rehabilitation, and seismic retrofit of these bridges.
This bill would include, among the projects that may be funded
from state-owned toll bridge revenues, a major project on the San
Francisco-Oakland Bay Bridge consisting of a
bicycle-pedestrian-maintenance pathway linking the pathway on the
replacement eastern span with San Francisco, subject to certain
conditions. The bill would provide that the project may be sponsored
by the Metropolitan Transportation Commission. The bill would
prohibit the Bay Area Toll Authority from increasing tolls to fund
this project.

THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:
SECTION 1. Section 30914.2 is added to the Streets and Highways
Code, to read:
30914.2. (a) In addition to any other
authorized expenditures of toll bridge revenues, a major project on
the San Francisco-Oakland Bay Bridge consisting of a
bicycle-pedestrian-maintenance pathway linking the pathway on the
replacement eastern span with San Francisco may be funded from toll
revenues under the jurisdiction of the Bay Area Toll Authority,
provided that the project is included in the adopted regional
transportation plan. The pathway may include the capacity for
maintenance vehicles if it does not lower the bridge's height above
the shipping channel. Prior to approving the project and authorizing
construction, the authority shall make a finding that the pathway
does not fundamentally alter the profile of the bridge. The project
may be sponsored by the Metropolitan Transportation Commission. The
authority may not increase tolls to fund this project, and
subdivision (b) of Section 30918 shall not apply to this project.
(b) Project sponsors shall seek funding for the project identified
in subdivision (a) from all other nonstate sources, including
federal matching funds, and report to the authority concerning any
funds obtained in that regard.
SEC. 2. Section 30915 of the Streets and
Highways Code is amended to read:
30915. With respect to all construction and improvement projects
specified in Sections 30913, 30914, and 30914.2, project sponsors and
the department shall seek funding from all other potential sources,
including, but not limited to, the State Highway Account and federal
matching funds. The project sponsors and department shall report to
the authority concerning the funds obtained under this section.
