TULARE LAKE BASIN
Background and Existing Law
The State Department of Water Resources (DWR) regularly
revises the California Water Plan. DWR's Bulletin 160-09
is the "California Water Plan Update 2009."
DWR must also prepare the Central Valley Flood Protection
Plan. Within two years of the Plan's adoption by the
Central Valley Flood Protection Board, cities and counties
in the Sacramento-San Joaquin Valley must amend their
general plans to protect lives and property. The statutory
definition of the Sacramento-San Joaquin Valley
specifically excludes the Tulare Lake basin, including the
Kings River (SB 5, Machado, 2007).
As DWR started implementing the 2007 legislation, its maps
placed some of the City of Fresno in the Sacramento-San
Joaquin Valley planning area. Because the statute
specifically excluded the Tulare Lake basin from that
planning area, Fresno officials want the Legislature to
clarify the exclusion.
Proposed Law
Senate Bill 1070 defines the "Tulare Lake basin" as the
Tulare Lake Hydrologic Region as defined by the California
Water Plan Update 2009.
Comments
Over the line . To clarify what land is outside the
Sacramento-San Joaquin Valley planning area for flood
protection, SB 1070 creates a specific definition that
relies on the California Water Plan's designation of the
Tulare Lake basin.
