          Commission to include self-defense instruction, as defined,  
          and safety instruction, as defined, in the next revision of  
          the physical education framework for pupils in grades 7, 8,  
          9, 11, and 12.

           Assembly Amendments  add the Curriculum Development and  
          Supplemental Materials Commission to include self-defense  
          and safety instruction in the next revision of physical  
          education framework for students in grades 7,8,9, 11 and  
          12.

           ANALYSIS  :    Existing law requires that all pupils in  
          grades 7 to 12, inclusive, except those excused or exempted  
          pursuant to a prescribed provisions of law, attend physical  
          education courses for a total period of time of not less  
          than 400 minutes each 10 schooldays.  Pursuant to its  
          authority to issue program guidelines to serve as models or  
          examples, the State Board of Education (SBE) has adopted  
          physical education model content standards for California  
          public schools.

          This bill requires SBE and the Curriculum Development and  
          Supplemental Materials Commission (Curriculum Commission)  
          to include self-defense and safety instruction in the next  
          revision of the physical education (PE) framework for  
          students in grades 7, 8, 9, 11 and 12.  Specifically, this  
          bill defines: 

          1. "Self-defense instruction" to include, but not  
             necessarily be limited to, martial arts, boxing, and  
             other defensive techniques. 

          2. "Safety instruction to include", but not necessarily be  
             limited to, awareness and avoidance of potentially  
             dangerous situations. 

           Background  

          The processes for reviewing frameworks and adopting  
          instructional materials has been suspended since July 2009,  
          pursuant to AB 2 (Evans), Chapter 2, Statutes of 2009-10,  
          Fourth Extraordinary Session, which among other things,  
          prohibited SBE from reviewing frameworks and adopting

          instructional materials until the 2013-14 school year.

          According to the Assembly Appropriations Committee: 

          1. General Fund (GF) administrative costs to the California  
             Department of Education (CDE), likely between $100,000  
             and $140,000, to establish a panel for the purpose of  
             adopting a PE curriculum framework.  This assumes all or  
             a portion of the Curriculum Commission's funding is  
             restored to complete the development of the PE  
             curriculum framework, as specified. 

          2. Due to the enactment of AB 2 X4 (Evans), Chapter 2,  
             Statutes of 2009-10, Fourth Extraordinary Session, the  
             Governor vetoed $705,000 (GF) for the Curriculum  
             Commission, which conducts the majority of the work  
             associated with instructional materials (IM) adoptions,  
             including developing curriculum frameworks.   
             Specifically, the Governor stated, "it is unnecessary  
             for the curriculum commission to continue to advise the  
             SBE on content frameworks and IM adoptions for the next  
             five years or until an agreed-upon process is  
             reestablished.  This reduction removes funding for  
             unnecessary commission per diem and travel as well as  
             funding for CDE staff."

           ARGUMENTS IN SUPPORT  :    According to the author, "although  
          certain components of self-defense may be provided to  
          students in grades 7-12, the physical education frameworks  
          do not clearly demonstrate that training students to  
          recognize potential threats of physical attack by another  
          person."
