SB 1321 (Kehoe) - As Amended: April 15, 2010
SUBJECT : State Race Track Leasing Commission: Director of General
Services: powers and duties.
SUMMARY : Authorizes that the director (director) of the
Department of General Services (DGS) and secretary of the
Department of Food and Agriculture (CDFA) may designate a deputy
to act in his or her place on the State Race Track Leasing
Commission (SRTLC) with all the rights and powers as the
respective director for SRTLC.
EXISTING LAW created SRTLC, composed of the directors of CDFA,
Department of Finance (DOF), and DGS and three individuals,
appointed by the Governor, who are members of the Board of
Directors of the 22nd District Agricultural Association. The
director of DOF shall serve as chairperson of SRTLC. (Food and
Agriculture Code Section 4351)
Provides that the director of any state agency may designate a
deputy director of the department to act in place or stead of the
director on a state board, commission, committee, or the governing
body of any state agency or authority and specifies that no more
than one director may be represented by a deputy at any meeting or
session. Specific provisions provides that the State Controller,
State Treasurer, Director of DOF, or the Superintendent of Public
Instruction may designate any deputy director of his/her office to
act in place or stead on any state board, commission, committee,
or governing board of a state agency or authority. (Government
Code Section 7-7.9a)
FISCAL EFFECT : This bill is keyed non-fiscal by Legislative
Council.
COMMENTS : The directors of CDFA and DGS are members on SRTLC.
Both are allowed to designate a deputy to attend SRTLC meeting.
Due to current law, only one director is allowed to have a deputy
at meetings. This has created a situation were only CDFA or DGS
is allowed to attend SRTLC meetings, unless the directors attend.
This bill would allow designated CDFA and DGS deputies assigned to
SRTLC to attend and exercise the duties of the respective

directors at the same time. The director of DOF has this
authority under current law. While this is an expansion of
authority for the directors of CDFA and DGS, it is limited to
SRTLC.
