   An act relating to  workers' rights   the
California Conservation Corps, and making an appropriation therefor

   SB 1326, as amended, Oropeza.  Workers' rights. 
 California Conservation Corps: local conservation corps. 

   (1) The Electronic Waste Recycling Act of 2003 requires a retailer
selling a covered electronic device in this state to collect a
covered electronic waste recycling fee from the consumer. Under
existing law, the fees are deposited in the Electronic Waste Recovery
and Recycling Account of the Integrated Waste Management Fund and
are continuously appropriated for specified purposes.  
   This bill would appropriate $15,000,000 from that account to the
California Conservation Corps for the purposes of making direct
grants to certified local community conservation corps to collect and
recycle covered electronic devices, as defined, consistent with the
Electronic Waste Recycling Act of 2003, and for activities related to
that collection and recycling. The bill would also appropriate
$10,000,000 from that account to the California Conservation Corps to
collect and recycle those covered electronic devices.  
   (2) The California Tire Recycling Act requires a person who
purchases a new tire to pay a California tire fee and the revenue
generated from the fee is deposited in the California Tire Recycling
Management Fund, for expenditure by the Department of Resources
Recycling and Recovery, upon appropriation by the Legislature, for
programs related to the disposal of waste tires, except that a
specified amount of the fee is designated for programs and projects
that mitigate or remediate air pollution caused by waste tires. 

   This bill would appropriate $5,000,000 from that fund to the
California Conservation Corps for the purposes of making direct
grants to certified local community conservation corps to collect and
recycle waste tires consistent with the California Tire Recycling
Act, and for activities related to that collection and recycling.
 
   (3) Item Number 3340-101-6051 of Section 2.00 of the Budget Act of
2009, as added by Chapter 1 of the 2009-10 4th Extraordinary
Session, appropriated $6,700,000 to the California Conservation Corps
for local assistance, payable from the Safe Drinking Water, Water
Quality and Supply, Flood Control, River and Coastal Protection Fund
of 2006.  
   This bill would reappropriate that amount for the support of the
California Conservation Corps, subject to the purposes and
limitations of that appropriation, and would provide that those funds
would be available for encumbrance until June 30, 2013. The bill
would also reappropriate certain funds that were reappropriated to
the California Conservation Corps by Item 3340-490 of Section 2.00 of
the Budget Act of 2009, as added by Chapter 1 of the 2009-10 4th
Extraordinary Session, for local assistance grants to local
conservation corps, payable from that fund.  
   Existing law regulates the terms and conditions of employment in
the state and secures to workers various enforceable rights.
 
   This bill would state the intent of the Legislature to enact
legislation relating to labor and workers' rights.

THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:

   SECTION 1.    (a) The Legislature hereby finds and
declares that it is in the interests of the state and its citizens to
create jobs and employment opportunities for unemployed youth
performing environmental projects.  
   (b) Notwithstanding Section 42476 of the Public Resources Code,
the sum of ten million dollars ($10,000,000) is hereby appropriated
from the Electronic Waste Recovery and Recycling Account in the
Integrated Waste Management Fund to the California Conservation Corps
for the purposes of collecting and recycling covered electronic
devices, as defined in Section 42463 of the Public Resources Code,
consistent with Chapter 8.5 (commencing with Section 42460) of Part 3
of Division 30 of the Public Resources Code, and for activities
related to that collection and recycling.  
   (c) Notwithstanding Section 42476 of the Public Resources Code,
the sum of fifteen million dollars ($15,000,000) is hereby
appropriated from the Electronic Waste Recovery and Recycling Account
in the Integrated Waste Management Fund to the California
Conservation Corps for the purposes of making direct grants to
certified local community conservation corps to collect and recycle
covered electronic devices, as defined in Section 42463 of the Public
Resources Code, consistent with Chapter 8.5 (commencing with Section
42460) of Part 3 of Division 30 of the Public Resources Code, and
for activities related to that collection and recycling.  
   (d) In addition to purposes specified in Section 42889 of the
Public Resources Code, the sum of five million dollars ($5,000,000)
is hereby appropriated from the California Tire Recycling Management
Fund, established by Section 42885 of the Public Resources Code, to
the California Conservation Corps for the purposes of making direct
grants to certified local community conservation corps to collect and
recycle waste tires consistent with Chapter 17 (commencing with
Section 42860) of Part 3 of Division 30 of the Public Resources Code,
and for activities related to that collection and recycling. 

   (e) Funds appropriated pursuant to subdivisions (c) and (d) shall
be used to provide immediate employment for at-risk youth and other
persons who are members of local community conservation corps, so as
to create new jobs, employ people in productive activities for fair
wages, and reduce unemployment in the state. 
   SEC. 2.    (a) The funds appropriated by Item No.
3340-101-6051 of Section 2.00 of the Budget Act of 2009, as added by
Section 167 of Chapter 1 of the 2009-10 Fourth Extraordinary Session,
for local assistance to the California Conservation Corps, that are
payable from the Safe Drinking Water, Water Quality and Supply, Flood
Control, River and Coastal Protection Fund of 2006 (Division 43
(commencing with Section 75001) of the Public Resources Code), are
hereby reappropriated, subject to the purposes and limitations of
that appropriation, and shall be available for encumbrance until June
30, 2013. 
   (b) The balances of the reappropriation provided by Item 3340-490
of Section 2.00 of the Budget Act of 2009, as added by Section 168 of
Chapter 1 of the 2009-10 Fourth Extraordinary Session, for local
assistance grants to local conservation corps, payable from the Safe
Drinking Water, Water Quality and Supply, Flood Control, River and
Coastal Protection Fund of 2006 (Item 3340-101-6051, Sec. 2.00 Budget
Act of 2008 (Chs. 268 and 269, Stats. 2008)), are hereby
reappropriated for the purposes of, and subject to that Item
3340-490, and shall be available for encumbrance until June 30, 2013.
 
  SECTION 1.   It is the intent of the Legislature
to enact legislation relating to labor and workers' rights.
