DIGEST : This bill updates Californias toy safety
statutes to reference the most current versions of federal
law and regulations.
Assembly Amendments delete the Senate version of the bill
and instead update existing toy safety statutes to reflect
changes in federal law.
ANALYSIS : Existing law prohibits a person from
manufacturing, selling, or exchanging, having in his/her
possession with intent to sell or exchange, or exposing or
offering for sale or exchange to any retailer, any toy that
is:
1. Contaminated with any toxic substance.
2. Coated with paints and lacquers containing compounds of

lead of which the lead content is in excess of that
permitted by regulations adopted pursuant to the Federal
Hazardous Substances Act.
3. Coated with paints and lacquers containing soluble
compounds of antimony, arsenic, cadmium, mercury,
selenium, or barium, as identified by specified
solubility tests.
This bill:
1. Updates California's toy safety statutes that prohibit
the manufacture or sale of any toy that is coated with
paints and lacquers containing compounds of lead to
reference the lead content permitted by federal
regulations adopted pursuant to the Consumer Product
Safety Act and the Consumer Product Safety Improvement
Act of 2008.
2. Updates California's toy safety statutes that prohibit
the manufacture or sale of any toy that is coated with
paints and lacquers containing soluble compounds of
antimony, arsenic, cadmium, mercury, selenium, or barium
to include chromium and to reference identification of
these compounds by ASTM [American Society for Testing
and Materials] International Standard F963-08 "Standard
Consumer Safety Specification for Toy Safety" (ASTM
F963).
Comments
This bill updates existing toy safety statutes to reflect
changes in federal law, regulations and standards. In
addition, it adds chromium, as identified in the ASTM
International Standard, to the list of soluble compounds
prohibited in the paints and lacquers of toys.
