To the Members of the California State Senate:

I am returning Senate Bill 1397 without my signature.

This bill would mandate that no two representatives from employee
organizations may be from the same labor organization and be members
of the California Apprenticeship Council.  In addition, this bill
would place new requirements on new or expanding apprenticeship
programs in the building and construction trades.

Similar to previous measures I have vetoed, this measure imposes new
requirements on new or expanding programs without subjecting existing
programs to the same level of scrutiny.  Finally, this measure fails
to address the impacts of the so-called "needs test" that prevents
new apprenticeship programs from being approved if a similar program
already exists in the same geographic area.

For these reasons, I am unable to sign this bill.
