BILL SUMMARY: This bill would authorize a local law enforcement
agency that has entered into a memorandum of understanding (MOU)
with the Department of Corrections and Rehabilitation (CDCR),
and that has primary jurisdiction over the location where a
parolee who is not subject to parole revocation resides, to
require that parolee to wear a global position system (GPS) or
other electronic monitoring device for the duration of the
parole period. This bill provides that this discretionary use of
electronic monitoring shall be funded by participating local law
enforcement agencies, and that they shall reimburse CDCR for
costs is incurs related to an MOU.

STAFF COMMENTS:
This bill does not place new mandates on local law enforcement
agencies, nor new requirements on CDCR. Its provisions
specifically authorize any local law enforcement agency to
require parolees who are not subject to parole revocation,
living in its jurisdiction, to submit to electronic monitoring,
as specified. If an agency chooses to pursue this policy, it is
required to enter into an MOU with CDCR to establish conditions
of electronic monitoring, and likely to address practical and
logistical considerations for both of the agencies.
CDCR does not have to agree to enter into an MOU with a local
law enforcement agency. To the extent that CDCR establishes and
agrees to MOUs with local law enforcement agencies, those
agencies will be responsible for reimbursing CDCR for its costs
"in preparing, entering into and performing any actions pursuant
to" an MOU. This bill also specifies that the local law
enforcement agency will be responsible for all other costs of
electronic monitoring authorized by this bill.
