           SUBJECT  :    Public Utilities Commission:  reporting

           DIGEST  :    This bill repeals and amends several sections of  
          the Public Utilities Code and the Public Resources Code  
          which are obsolete.

           Assembly Amendments  places provisions of SB 1462 (Padilla)  
          into this bill, since SB 1462 is being used for other  
          purposes.  (1) corrects certain existing references in the  
          Public Utilities Code by revising "electric corporation" to  
          "electrical corporation", (2) requires the chair of the  
          State Energy Resources Conservation and Development  
          Commission to appear annually before the appropriate policy  
          committees of the Senate and Assembly to report on the  
          activities of the commission, (3) revises provisions in  
          statute to refer to local exchange carrier, instead of  
          local exchange service providers and local exchange  
          telephone corporation, (4) removes the repealing of a  
          provision in law concerning wharfinger to condemn property,  
          and (5) removes the repealing language requiring the  
          California Public Utilities Commission (CPUC) to evaluate  
          and implement failure to promote the use of electric power  
          and natural gas to fuel low-emission fuel vehicles and  
          report to the Legislature.

          ANALYSIS  :    Existing law requires the Secretary of the  
          California Environmental Protection Agency to address  
          various issues concerning the cost-shifting between classes  
          of utility ratepayers and to provide reports to the  
          Legislature no later than 1997 and 2001.

          This bill repeals this obsolete provision.

          Existing law requires the CPUC to monitor and participate  
          in a 1999 proceeding of the federal Communications  
          Commission.

          This bill repeals this obsolete provision.

           GOVERNOR'S VETO MESSAGE  :  
           
             "I am returning Senate Bill 1467 without my  
             signature. 

             In addition to making several non-substantive changes  
             to the Public Utilities Code and the Public Resources  
             Code, this bill requires the Chairperson of the State  
             Energy Resources Conservation and Development  
             Commission (Commission) to appear annually before the  
             Senate Committee on Energy, Utilities and  
             Communications and the Assembly Committee on  
             Utilities and Commerce to report on the activities of  
             the Commission. 

             This bill is unnecessary.  During my Administration,  
             the Chairperson of the Commission has always been  
             accessible to the Legislature and, in fact, has  
             appeared on several occasions this year before both  
             committees to report on Energy Commission activities.  


             If the Legislature would like to invite the  
             Chairperson to appear before their committees, they  
             simply need to call.  In this bill's absence, I am  
             ordering DGS to check all phone lines between the  
             Legislature and the Chairperson's office to make sure  
             they are in good working order."
