            SB 1478 (Senate Committee on Natural Resources and Water) - As  
                               Amended:  June 14, 2010

          SUBJECT  :   Water conservation

           SUMMARY  :   This bill makes technical changes to two provisions  
          governing water conservation.  Specifically,  this bill  : 

          1)Grants urban wholesale water suppliers the same six-month  
            extension to adopt urban water management plans (UWMPs) that  
            was granted to retail water suppliers.

          2)Updates a reference from former Presidential Executive Order  
            13423 to current Presidential Executive Order 13514. Both  
            mandate federal agencies conserve water.

           EXISTING LAW  : 

          1)Directs the state to achieve a 20 percent reduction in urban  
            per capita water use in California by December 31, 2020.  

          2)Requires urban retail water suppliers to develop urban water  
            use targets that will cumulatively result in the 20 percent  
            reduction referenced above.

          3)Directs an urban retail water supplier that supplies water to  
            a military installation to consider that installation's  
            requirements under federal Executive Order 13423.

           FISCAL EFFECT  :   None

           COMMENTS  :    

          SB 7 ((Steinberg), Chapter 5, Statutes of 2009-2010 Seventh  
          Extraordinary Session) requires, among other things, the state  
          achieve a 20 percent reduction in urban per capita water use by  
          December 31, 2020.  SBX7 7 provided three specific methods for  
          urban retail water suppliers to meet the 20 percent reduction  
          goal, and a fourth method to be developed by the Department of

          Water Resources (DWR).

          To allow urban retail water suppliers to use the to-be-developed  
          DWR method, SBX7 7 granted them a six month extension, to July  
          1, 2011, to adopt their statutorily required UWMPs.  However,  
          while SBX7 7 imposed the same UWMP requirements on urban  
          wholesale water suppliers, it inadvertently neglected to grant  
          them the same six month extension to adopt UWMPs that was  
          granted to their retail customers.  This bill corrects that  
          oversight.
           
          This bill also corrects a reference to a federal executive order  
          regarding federal agency conservation that can be considered by  
          an urban retail water supplier who supplies a military base.   
          Executive Order 13423, signed by President Bush on January 26,  
          2007 was superseded by Executive Order 13514, signed by  
          President Obama on October 8, 2009.  

          In March and April of this year the Assembly Water, Parks and  
          Wildlife Committee heard similar legislation which was approved  
          by consent: AB 1677 (Caballero) and AB 2277 (Fletcher).
