SUBJECT
California State Lottery.
DESCRIPTION
SB 1482 corrects an erroneous cross-reference contained in
the California State Lottery Act (Lottery Act or Act) of
1984.
EXISTING LAW
The California State Lottery Act of 1984, enacted by
initiative, authorizes a California State Lottery for the
purpose of providing additional moneys to benefit
education.
Existing law, Section 8880.4(a)(3) of the Government Code,
provides that all unclaimed prize money shall revert to the
benefit of public education.
Existing law, Section 8880.321(e) of the Government Code,
provides that if a valid claim is not made for a prize
within the period applicable for that prize, the unclaimed
prize money shall be treated as set forth in subdivision
(a) of Section 8880.4.
BACKGROUND
Purpose of the bill . SB 1482 is a technical clean-up bill

Lottery Act.
Background . On November 6, 1984, California voters passed
Proposition 37, an initiative that enacted the California
State Lottery Act of 1984 and created the California State
Lottery. The purpose of the Lottery Act is to provide
supplemental funding for the benefit of public education.
The Lottery Act is found in Government Code Sections 8880 -
8880.72. In current law, Government Code Section
8880.4(a)(3) contains a cross-reference to Section 8880.32
of the Government Code. Section 8880.32 of the Government
Code was repealed and renumbered to 8880.321 by AB 218
(Chapter 363, Statutes of 1995). AB 218 of 1995 did not
make a corresponding change to Government Code Section
8880.4(a)(3), which cross-referenced section 8880.32.
SB 1482 corrects the erroneous cross-reference contained in
the Act by replacing the reference to "8880.32" to
"8880.321" in Government Code Section 8880.4(a)(3).
PRIOR/RELATED LEGISLATION
AB 1654 (Budget), Chapter 764, Statutes of 2008 . Would
have implemented a number of changes to the Lottery Act to
"modernize" the Lottery if the voters would have approved
Proposition 1C (which was placed on the ballot by SCA 12
(Resolution Chapter 143 of 2008) in May 2009. Included in
AB 1654 was a correction of the erroneous cross-reference
found in Section 8880.4(a)(3). The correction was in a
section of AB 1654 that would only become operative if the
voters passed Proposition 1C. The voters did not approve
Proposition 1C, therefore, the correction did not take
effect.
AB 218 (Richter), Chapter 363, Statutes of 1995 . Enacted
clean-up changes to Lottery Act authorizing court ordered
assignment of Lottery prizes under specified circumstances.
Inadvertently created an erroneous cross-reference in
Government Code Section 8880.4(a)(3).
