CONCURRENCE IN SENATE AMENDMENTS

SUMMARY : Makes statutory changes necessary to implement human
services-related portions of the 2011-12 budget.
The Senate amendments delete the Assembly version of this bill,
and instead contain the following provisions:
1)Foster Care and Child Welfare:
a) Adopt changes to effectuate the increase in Foster Care
rates by about 31%, pursuant to a recent court decision.
This will also increase rates for prospective Adoption
Assistance Payment, Kinship Guardianship Assistance Payment
(Kin-GAP), and Non-Related Legal Guardian payments. The
General Fund portion for the increase is $17.39 million in
2011-12;
b) Direct the Department of Social Services to provide an
update by January 10, 2012 regarding the use of the
existing Child Welfare Services Case Management System
(CWS/CMS) system and its adaptability in maintenance and
operation to various current and prospective program
requirements, as well as update on next steps on the
restart of the CWS/CMS Web project pursuant to clarity on
pending federal expectations;
c) Delay implementation of the Foster Youth Identity Theft
Program until July 1, 2013;
d) Suspend implementation of the Resource Family Approval
Pilot until January 1, 2012;
e) Extend the existing moratorium on Group Home
Applications, while continuing to allow for exceptions on a

case-by-case basis, until January 1, 2013; and,
f) Make technical changes to correct an inaccurate
reference to the state/county sharing ratios used for
recovery of overpayments in the foster care and adoption
assistance programs.
2)California Work Opportunities and Responsibility to Kids
(CalWORKs) Program:
a) Revise CalWORKs-related provisions of SB 72 (Budget and
Fiscal Review Committee), Chapter 8, Statutes of 2011,
including refinements to the AB 98 (Niello), Chapter 589,
Statutes of 2007, Subsidized Employment statute, changes to
simplify the implementation of the new 48-month time limit,
corrections to provisions regarding the suspension of the
CalLearn program so that recipients can avoid interruptions
and can continue to receive welfare-to-work services, and
clarification of eligibility for pregnant teens;
b) Rescind the policy adopted in SB 72 (Budget and Fiscal
Review Committee) as part of the March 2011 Budget package
on escalating grant cuts to cases serving only children in
the CalWORKs program; and,
c) Delete exemptions from work participation requirements
for specified parents or relative caregivers who are caring
for a child between the ages of 24 and 35 months of age,
inclusive. Those exemptions were enacted by SB 72 (Budget
and Fiscal Review Committee) in March 2011. This change
corresponds to a revised reduction amount of $376.9 million
(from the $427 million reduction that was included in the
March budget package) to the single allocation of funding
for CalWORKs administration, child care, and
welfare-to-work services.
3)In-Home Supportive Services (IHSS):
a) Revise IHSS-related provisions of SB 72 (Budget and
Fiscal Review Committee), Chapter 8, Statutes of 2011
including language to clarify the conditions for and intent
regarding a potential additional across the board reduction
in authorized hours, exempt recipients of specified other
home and community-based waiver programs from the
reduction, and rescind a previous policy on disallowing

restoration of lost IHSS hours through the Waiver of
Personal Care Services program (as it was determined that
the disallowance would likely actually result in increased
costs); and,
b) Direct the Department of Social Services, in
consultation with stakeholders, including at least the
counties and Public Authorities, to develop a new
rate-setting methodology for public authority
administrative costs, beginning with the 2012-13 fiscal
year.
4)Drug Medi-Cal:
a) Authorize the transfer of the Drug Medi-Cal program from
the Department of Alcohol and Drug Programs to the
Department of Health Care Services, effective July 1, 2012
in the interest of improving access and quality, as well as
effectively integrating Medicaid services; and,
b) Require the departments to convene and consult with
stakeholders in the formulation of a transition plan,
including specified components, and present this plan to
the Legislature by October 1, 2011, with updates on the
transfer provided during subsequent budget hearings after
that date.
5)Administration's Reorganization Proposals:
a) Eliminate the Health Care Quality Improvement and Cost
Containment Commission in the Health and Human Services
Agency, as proposed by the administration;
b) Eliminate the Continuing Care Advisory Committee in the
Community Care Licensing Division of the Department of
Social Services, as proposed by the administration;
c) Eliminate the California Health Policy and Data Advisory
Commission within the Office of Statewide Health Planning
and Development (OSHPD), as proposed by the Administration;
and,
d) Eliminate the California Rural Health Policy Commission
within OSHPD, as proposed by the Administration.

6)Other Provisions:
a) Declare that the state will reimburse local agencies or
school districts for any costs that the Commission on State
Mandates determines are mandated by the state.
1)Add an appropriation allowing this bill to take effect
immediately upon enactment.
AS PASSED BY THE ASSEMBLY , this bill expresses the intent of the
Legislature to enact statutory changes relating to the 2011
Budget Act.
