SUBJECT : Budget Act of 2011: Public Safety

DIGEST : This bill makes statutory changes necessary to
implement the Public Safety portions of the 2011-12 Budget.
Senate Floor Amendments of 7/6/11 make technical
corrections to the public safety trailer (SB 92) and the
realignment clean-up bills (AB 117). On June 28, 2011 the
Legislature passed AB 117, which enacted specified
technical and conforming revisions to the public safety
realignment bill passed earlier this year �AB 109 (Assembly
Budget Committee), Chapter 15, Statutes of 2011]. On that
same date, the Legislature passed the public safety budget
trailer bill (SB 92). These amendments make technical,
conforming corrections to these measures, as follows: (1)
Operative Dates - corrects the operative dates for various
sections in SB 92, including the creation of the new Board
of State and Community Corrections, its duties, and related
repeals and enactments; (2) Division of Juvenile Justice -
strikes subdivision (d) in Welfare and Institutions Code
Section 1731.5 as enacted by AB 109, in conformity with the

actions taken by the previous measures, to exclude the
Division of Juvenile Justice from the public safety
realignment; (3) Technical Clarifying Changes - makes
clarifying changes to Penal Code Sections 3000.8 and
3000.9, concerning the jurisdiction of the Board of Parole
Hearings over parolees on a hold in county jail on July 1,
2013, and with respect to parole revocation procedures
applicable to parolees paroled prior to October 1, 2011,
and makes a clarifying reference change to Penal Code
Section 1170; and (4) Chaptering - addresses any potential
chaptering issues by merging the changes to Penal Code
Section 830.5 in both AB 117 and SB 92.
ANALYSIS :
NOTE: The prior version of the bill (June 28, 2011)
contained the provisions of SB 92 which was
chaptered into law. The current version of the bill
makes cleanup amendments to SB 92 and
AB 117.
