BILL SUMMARY: AB 135 requires at least one member of the Air
Resources Board to be a current or former owner of a small
business.

STAFF COMMENTS:
The Air Resources Board has eleven members, appointed by the
Governor and approved by the Senate. The Chair of the Air
Resources Board is a full time position, while the remaining
members are part-time members. Current law specifies required
backgrounds for members of the Board. For example, one member
must have training in automotive engineering, one member must be
a physician or have expertise in public health, two members
represent the general public, and five members represent the
various regional air pollution control districts.
AB 135 requires that at least one member of the Board be a
current small business owner or have been an owner of a small
business within the last five years. (This does not replace any
of the existing prerequisites for membership. In other words, at
least one of the members of the Board, who fulfills the existing
prerequisites, must also be a small business owner.)
The provisions of AB 135 will sunset on January 1, 2017.
AB 135 has double-jointing language with AB 146 (Dickinson),

which increases the membership of the Air Resources Board to 13
members, to avoid chaptering issues.
The Air Resources Board indicates that any costs associated with
the bill will be minor and absorbable.
This bill is substantially similar to AB 2328 (Niello, 2010).
That bill failed passage in this committee.
