    An act to add Section 54712 to the Government Code,
relating to local agencies.   An act to repeal Part 7.5
(commencing with Section 36100) of Division 24 of the Health and
Safety Code, relating to state government   .

   AB 737, as amended, Huber.  Local agencies: benefit
assessments.   Model cities.  
   Existing law establishes a Model Cities Coordinator to, among
other things, coordinate all state activities in the Model Cities
program and a local Model Cities resources board to, among other
things, assist Model Cities programs with the design, development,
and operation of community projects, provide information to local
Model Cities programs about the availability of state and federal
assistance, and assist in coordinating the functions of local, state,
and federal agencies in Model Cities programs to achieve locally
defined objectives.  
   This bill would repeal those provisions.  
   Existing law authorizes local agencies to levy a benefit
assessment pursuant to the Benefit Assessment Act of 1982 to finance
specified costs.  
   This bill would authorize any local agency levying a benefit
assessment pursuant to this act to bring an action to determine the
validity of the assessment pursuant to specified provisions of
existing law relating to validating proceedings.

THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:
   
  SECTION 1.    Part 7.5 (commencing with Section 36100) of
Division 24 of the Health and Safety Code is repealed.  

  SECTION 1.    Section 54712 is added to the
Government Code, to read:
   54712.  Any local agency levying a benefit assessment pursuant to
this chapter may bring an action to determine the validity of the
assessment pursuant to Chapter 9 (commencing with Section 860) of
Title 10 of Part 2 of the Code of Civil Procedure.
