SUBJECT : Department of Alcoholic Beverage Control: report.
SUMMARY : Changes reporting requirements for the Department of
Alcoholic Beverage Control (ABC) relating to its annual report
to the Legislature to previous "fiscal year", instead of
"calendar year" activities, as specified in current law.
EXISTING LAW :
1) Establishes ABC and grants it exclusive authority to
administer the provisions of the Alcoholic Beverage Control Act
(Act) in accordance with laws enacted by the Legislature.
2) Requires ABC to make an annual report to the Legislature on
the department's activities, on or before March 1 of each year,
for the previous calendar year.
FISCAL EFFECT : Unknown.
COMMENTS :
Purpose of the bill : According to the author, ABC is required
to annually report to the
Legislature the activities and enforcement actions of the
department for the previous "calendar
year." However, funds budgeted, tracked and reported by the ABC
for their licensing and enforcement are administered by "fiscal
year", as determined by the annual Budget Act. This dual
tracking of "calendar year" and "fiscal year" reporting creates
unnecessary duplication of ABC's reporting duties while
increasing administrative costs and bureaucratic inefficiencies.
AB 749 would require the ABC to provide its annual report to the
Legislature based on the
previous "fiscal year", instead of the current "calendar year"
requirement. This measure will provide important streamlining
within ABC which will allow for more time and monies to be
dedicated towards other matters.
