SUMMARY
This bill requires appointed state board and commission members
who receive a salary to submit quarterly reports to the chair of
the board that details their time worked. Specifically, this
bill:
1)Requires all appointed state board and commission members who
receive a salary that is set in statute, and is greater than
the per diem expenses claimed by the member, to report to the
chair of the board each quarter the details of the time worked
by the member in fulfilling his or her duties.
2)Requires that the time worked be reported in increments of
hours and tenths of hours.
3)Requires the chair of the board or commission provide a report
to the Senate and Assembly Rules Committees, and any policy
committee that has jurisdiction over the subject area of the
board that includes copies of the reports received by the
chair.
FISCAL EFFECT
Unknown costs, potentially in excess of $200,000 (various funds)
for each board to produce quarterly reports that detail the
workload of each of its members.
COMMENTS
1)Rationale . The intent of this legislation is to provide the
Legislature with information concerning the workload of

various boards and commissions and their individual members.
According to the author, "Many of these boards and commissions
meet only a few times per year and since members are not
required to track their time worked, it is unclear whether or
not they are working an amount of time that would justify
their salaries."

be subject to the requirements of this bill:

3)Related Legislation .
a) AB 1659 (Huber; Chapter 666, Statutes of 2010) created a
joint sunset review committee and tasks it with reviewing
on a periodic basis, every non-constitutional agency and
department within the state, with the exception of those
associated with postsecondary education.
b) AB 2130 (Huber; Chapter 670, Statutes of 2010) makes
specified boards subject to review by a new Joint Sunset
Review Committee.
c) AB 579 (Huber) of 2009 eliminated the current salary
authority for paid state boards and commissions and

establishes new requirements for setting the salaries for
boards and commissions. That bill was vetoed. In his veto
message, Governor Schwarzenegger wrote, "the legislature
already has a process in place through its Joint
Legislative Audit Committee, to request audits conducted by
the California State Auditor on virtually any state
operation."
d) AB 1501 (V. Manual Perez) required the salary of a board
member making $100,000 or more to be prorated to actual
hours worked in any given month where the board member does
not work full time, as specified. That bill was held on
this committee's suspense file.
e) AB 2539 (Strickland) of 2008 prohibited a member of a
state board or commission from receiving any salary in 2007
or later, if the position of the member on the state board
or commission received or would receive a salary totaling
at least $100,000 per year, and the members of the state
board or commission are required to meet less than three
times per month. AB 2539 died in the Assembly Business and
Professions Committee.
