   An act to add Section 1232 to the Government Code, relating to
public employees.


	LEGISLATIVE COUNSEL'S DIGEST


   AB 1018, as introduced, Donnelly. Public employees.
   Existing law authorizes the state, each city, each city and
county, and each county to employ people.
   This bill would require all state, city, city and county, and
county employees to verify each person who requests state-funded
benefits through the United States E-Verify Program that is an
electronic verification of work authorization program of the Illegal
Immigration Reform and Immigration Responsibility Act of 1996.
   The California Constitution requires the state to reimburse local
agencies and school districts for certain costs mandated by the
state. Statutory provisions establish procedures for making that
reimbursement.
   This bill would provide that, if the Commission on State Mandates
determines that the bill contains costs mandated by the state,
reimbursement for those costs shall be made pursuant to these
statutory provisions.

THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:

  SECTION 1.  Section 1232 is added to the Government Code, to read:
   1232.  (a) All state, city and county, county, and city employees
shall verify each person who requests state-funded benefits through
the United States E-Verify Program.
   (b) Any state, city and county, county, or city employee who
knowingly gives out any state-funded benefits to a person who is in
the state illegally shall be held personally responsible and shall
receive disciplinary action in accordance with his or her employer's
established human resources reprimanding guidelines.
  SEC. 2.  If the Commission on State Mandates determines that this
act contains costs mandated by the state, reimbursement to local
agencies and school districts for those costs shall be made pursuant
to Part 7 (commencing with Section 17500) of Division 4 of Title 2 of
the Government Code.
