SUBJECT : CARPET RECYCLING
SUMMARY :
Existing law :
1) Establishes a product stewardship program for carpets for
the purpose of increasing the amount of postconsumer carpet
that is diverted from landfills (Public Resources Code
§42970 et seq.).
2) Prohibits carpet producers and retailers from selling
carpet in California unless the producer or a carpet
stewardship organization has submitted a stewardship plan
to the Department of Resources Recycling and Recovery
(DRRR) with the goal of increasing the recycling of
postconsumer carpet
(§42974).
3) Requires Department of General Services (DGS), to the
extent feasible and within existing resources, to take
appropriate steps, including revising relevant procurement
rules, to ensure that postconsumer carpet that is removed
from state buildings is managed in a manner that is
consistent with state policy (§42982).
This bill :
1) Establishes a date certain of January 1, 2014, for DGS to
ensure postconsumer carpet that is removed from state
buildings is managed in a manner that is consistent with
state policy.

2) Defines "state buildings" as those buildings owned or
leased by the state.
COMMENTS :
Purpose of Bill . According to the author, state buildings are
a major generator of waste carpet. Current law requires DGS to
manage waste carpet in state buildings but does not set a
deadline for compliance. AB 2398 (John A. Pérez) Chapter 681,
Statutes of 2010, established a product stewardship program
that requires California carpet manufacturers to prepare a
carpet stewardship plan that maximizes the diversion of
postconsumer carpet and encourages the recycling of waste
carpet into secondary products. AB 2398 also requires DGS to
take appropriate steps to ensure that carpets removed from
state buildings are managed consistently with statutes
relating to carpet recycling, but did not set a date by which
DGS should meet that requirement. This bill requires DGS to
perform its duties under the existing carpet recycling law by
January 1, 2014.
