SUMMARY
This bill authorizes a property transfer between the state and
the City of Carlsbad in San Diego County. Specifically, this
bill:
1)Authorizes the Director of General Services (DGS), on behalf
of the Department of Parks and Recreation (DPR), to exchange
portions of South Carlsbad State Beach with excess city
property created through the realignment of Carlsbad
Boulevard.
2)Stipulates the City shall reimburse the state for (a) the
difference in appraised values of the properties if the state
property is found to have a higher appraised value, and (b)
the state's administrative costs to complete the transfer.
3)Stipulates that the City is solely responsible for compliance
with the California Environmental Quality Act and the federal
Land and Water Conservation Fund (LCWF) Act of 1965 in
connection with the property exchange.
FISCAL EFFECT
No net cost to the state, pursuant to (2) and (3) above.
COMMENTS
Purpose . The land transfer proposed in this bill allows DPR to
acquire approximately 26.1 acres of property from the City in
exchange for delivering two parcels of state property totaling
14.1 acres. The City intends to use the acquired land to create

a T-intersection at Carlsbard Blvd. and Palomar Airport Road and
a city park. DPR intends to use the acquired land to expand and
upgrade the South Carlsbad State Beach Campground campsites,
facilities, parking, and entrance road. While a MOU outlining
the role and responsibilities of the parties has been prepared,
DPR has not yet signed the MOU.
This land transfer is complicated because a portion of state
beach was acquired utilizing federal LWCF funds, hence the state
incurred federal restrictions that any land traded or acquired
must meet or exceed the recreational value, acreage, and
appraised value of the land to be exchanged. In order to
complete a land transfer with these federal restrictions, the
transfer must be first approved on the federal level, which will
take several months.
