SUMMARY
This bill requires the Department of Motor Vehicles (DMV) to
refuse registration for a commercial motor vehicle that is a
1996 or older model year and requires a class A or B commercial
driver's license. The bill exempts from its provisions a
commercial motor vehicle registered in California prior to
January 1, 2012, if the vehicle is continuously registered on
and after January 1, 2012, or is certified nonoperational after
January 1, 2012.

COMMENTS
1)Rationale . The author intends his bill to prevent the
importation of older, highly polluting commercial trucks into
California. According to the author, the Air Resources
Board's (ARB) recent amendment to its truck and bus rule
provided needed flexibility to fleet operators seeking to
comply with the rule. However, the author adds, the amendment
also created an opportunity for an increase in pre-1996
vehicles registered in California, which could result in
higher emissions and undercut California businesses in
compliance with the original rule.

2)Background. The ARB Truck and Bus Regulation requires fleets
that operate in California to reduce diesel truck and bus
emissions by retrofitting or replacing existing engines. As
recently amended, the rule requires fleets to install the best
available particulate matter filter on 1996 model-year and
newer engines and to replace these vehicles eight years later.
Trucks with 1995 model-year and older engines would be
replaced starting 2015. By 2023, all trucks and buses must
have 2010 model-year or newer engines, with few exceptions.
3)Support. This bill is supported by the California Trucking
Association (sponsor).
