CONCURRENCE IN SENATE AMENDMENTS

SUMMARY : Clarifies the authority of the State Auditor (SA) to
conduct audits of the judiciary, and includes all Bureau of State
Audits' (BSA) costs under their continuous appropriation authority.
The Senate amendments :
1)Define "confidentiality of records or property" to mean the record
or property that may lawfully be kept confidential as a result of a
statutory or common law privilege or any other provision of law.
2)Redefine "improper governmental activity" to also include:
a) Violations of an executive order, court decision, State
Administrative Manual or State Contracting Manual; and,
b) Gross misconduct, incompetency, or inefficiency.
3)Require a state agency to disclose the opportunity to submit
whistleblower complaints to the SA under the California
Whistleblower Protection Act whenever a state agency posts or
advertises the opportunity to submit complaints through a program
the agency administers.
4)Repeal obsolete provisions relating to the Auditor General's office
and duties.
5)Repeal the requirement that the SA, Controller, and Department of
Finance prepare separate plans according to a division of specified
primary duties.
6)Make clarifying and technical changes.

1)Sets forth the duties and powers of BSA and makes reference to
audits and investigative audits.
2)Prohibits the SA or his or her employees from releasing to the
public, among other things, any papers, correspondence, or any
substantive information pertaining to any audit not completed.
AS PASSED BY THE ASSEMBLY , this bill was substantially similar to the
version approved by the Senate.
FISCAL EFFECT : According to the Senate Appropriations Committee,
pursuant to Senate Rule 28.8, negligible state costs.
