An act to add Section 12811.2 to the Vehicle Code, relating to
vehicles.
LEGISLATIVE COUNSEL'S DIGEST
AB 1202, as introduced, Jeffries. Vehicles: driver's license
applicant: organ and tissue donation.
Existing law requires the Department of Motor Vehicles to issue a
driver's license, as applied for, to a person the department
determines to be lawfully entitled to the license. Existing law
prescribes various fee amounts that are to be paid to the department
upon application for an original or renewal license or identification
card. Existing law also requires an application for an original or
renewal driver's license or identification card to contain a space
for the applicant to enroll in the Donate Life California Organ and
Tissue Donor Registry.
This bill would require a person who enrolls in the Donate Life
California Organ and Tissue Registry when submitting an application
for an original or renewal driver's license or identification card to
receive a discount on the application fee in an unspecified amount.
The bill would require the department to work with several federal
agencies, including the United States Department of Health and Human
Services to secure appropriate federal funding to implement the
discount requirement. The bill would make the provisions operative
when the Director of Motor Vehicles certifies that the department has
secured the necessary federal funding to implement the discount
requirement.

THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:
SECTION 1. Section 12811.2 is added to the Vehicle Code, to read:
12811.2. (a) A person who enrolls in the Donate Life California
Organ and Tissue Donor Registry, pursuant to subdivision (b) of
Section 12811, when submitting an application for an original or
renewal driver's license or identification card, shall receive a
discount on the application fee for the driver's license or the
identification card in the amount of _____ ($____).
(b) The department shall work with the United States Department of
Health and Human Services and the Centers for Medicare and Medicaid
Services in order to secure the necessary funding from the federal
government in order to implement subdivision (a).
(c) (1) This section shall become operative when the director of
the department certifies that the department has secured the
necessary funding pursuant to subdivision (b).
(2) The director of the department shall notify the Secretary of
State when this section becomes operative pursuant to paragraph (1).
