         SUMMARY  :  Requires fictitious business name (FBN) statements to 
        contain language specifying that false declarations are a 
        misdemeanor punishable by a fine of up to $1,000 and requires FBN 
        statement registrants or their agents to provide specified personal 
        identification information at the time of filing, beginning  January 
        1, 2014.  

         The Senate amendments  :

        1)Make the bill's provisions operative on January 1, 2014.

        2)Replace references to "husband and wife" with "a married couple" 
          and make conforming changes.

        3)Allow a third-party agent to file on behalf of a registrant and 
          present the personal identification information specified in this 
          bill.

        4)Specify that the alternative identification that can be presented 
          to the county clerk must be government identification.

        5)Allow the county clerk to require a registrant or an agent of a 
          registrant to sign an affidavit of identity statement, as 
          specified.

        6)Revise and recast the forms of identification that shall be deemed 
          acceptable for corporations, limited liability companies, and 
          limited liability partnerships.

        7)Revise and recast the requirements for FBN statements that are 
          mailed to a county clerk's office for filing.

        8)Make conforming changes.

         AS PASSED BY THE ASSEMBLY  , this bill required FBN statements to 
        contain language specifying that false declarations are a 
        misdemeanor punishable by a fine of up to $1,000, and required FBN 
        statement registrants to provide specified personal identification 
        information at the time of filing.

         FISCAL EFFECT  :   According to the Senate Appropriations Committee, 
        pursuant to Senate Rule 28.8, negligible state costs.

         COMMENTS  :  This bill was amended in the Senate, and is consistent 
        with Assembly actions.
