SUBJECT : Obsolete Reports
SUMMARY : AB 1431 deletes specified, obsolete mandated reports
from statute and from the Legislative Counsel list of mandated
reports. Specifically, this bill : deletes 18 reports from
statute and deletes 137 reports from the Legislative Counsel
list.
1) The reports that would be deleted from statute are:
Reports due from the Little Hoover Commission
Description: Comprehensive analysis of scope of practice,
educational requirements, certification and accreditation for
acupuncturists, due by September 1, 2004.
Authority: Section 4934.1 of the Business and Professions Code
Reports due from the State Teachers Retirement System Board
Description: Report to the fiscal committees of the Legislature
and to the Director of Finance the return on investments and
actual payroll subject to the system for the prior fiscal year,
due on March 1, 1995, and annually thereafter.
Authority: Section 2218.5 of the Education Code
Description: Report on the extent to which inflation has eroded
the purchasing power of benefits provided under the Defined
Benefit Program, due no later than June 1 of each year.

Reports due from the Oil Spill Technical Advisory Committee
Description: Submit comments to the Governor and Legislature
pertaining to the Department of Finance report required under

Description: Audits conducted, as deemed necessary, of the
allocations or expenditures made in accordance with Article XIXB
of the California Constitution (Motor Vehicle Fuel Sales Tax

delete requirement to submit audit reports to Legislature, but
the department would still have discretion to conduct audits.

EXISTING LAW Government Code section 10242.5 requires
Legislative Counsel to maintain and update an electronic list of
all reports that state and local agencies are required to
prepare and file with the Governor or Legislature, removing
obsolete or duplicate reports from the list. This section also
defines "obsolete report" to mean a report that has not been
completed and filed and for which the date that report was
required to be completed and filed was four or more years after
the initial report is submitted.
FISCAL EFFECT : Unknown potential savings due to resources that
can be redirected into the core mission of the affected
agencies.
COMMENTS : This bill is similar to AB 1585 (Committee on
Accountability & Administrative Review), Chapter 7, Statutes of
2010. AB 1585 revised the method for state and local agencies
to submit reports to the Legislature, for the Legislature to
receive and catalogue mandated reports, and it required any new
report requirement to include a sunset date. AB 1585 also
deleted nearly 1,500 obsolete reporting requirements from the
list of over 2,800 reports maintained by Legislative Counsel.
This bill deletes specified reports from statute and contains a
listing of existing reports identified as obsolete to be deleted
from the list maintained by Legislative Counsel. The reports
listed in AB 1431 were identified by the Governor's Office of

Planning and Research (OPR), the Department of Finance and the
State and Consumer Services Agency as obsolete. OPR staff
indicates that they defined "obsolete reports" as those that are
no longer necessary and have not been completed for three or
more years.
On December 12, 2011, Governor Brown issued Executive Order
B-14-11 which requires "agency secretaries and department
directors prepare a list of all reports that they are required
to submit to the Legislature, and identify those that may no
longer be of significant value to the Legislature." Agencies
and departments are required to provide this information to the
Department of Finance, which in turn will work with the
Legislature to determine which reporting requirements should be
deleted.
On December 21, 2011, the Department of Finance issued Budget
Letter 11-35 which provides guidance on identifying obsolete
reports and the method for submitting this information to the
Department of Finance. The letter also establishes a deadline
of January 31, 2012 for agencies and departments to submit the
specified information. This bill could be expanded to include
these reports which, some of which may not meet the Legislative
Counsel definition of "obsolete," but have been determined to be
of little or no value.
