           SUBJECT  :    California Environmental Quality exemption

           DIGEST  :    This bill exempts the Los Angeles Regional 
          Interoperable Communications System (LA-RICS) project from 
          California Environmental Quality Act (CEQA).

           Senate Floor Amendments  of 8/24/12 delete the prior version 
          of the bill which expressed Budget Trailer Bill legislation 
          intent and replace it with the above language.

           ANALYSIS  :    CEQA requires lead agencies with the principal 
          responsibility for carrying out or approving a proposed 
          discretionary project to prepare a negative declaration, 
          mitigated declaration, or environmental impact report for 
          this action, unless the project is exempt from CEQA (CEQA 
          includes various statutory exemptions, as well as 
          categorical exemptions in the CEQA guidelines).  (Public 
          Resources Code Section 21000 et seq.).

          This bill exempts from CEQA until January 1, 2017, the 
          design, site acquisition, construction, operation, or

          maintenance of certain LA-RICS structures, if certain 
          conditions are met (e.g., project would not have a 
          substantial adverse impact on wetlands, riparian areas, or 
          historical areas; operation of the project would not exceed 
          certain Federal Communications Commission exposure 
          standards).

          LA-RICS plans the following towers that would be exempt 
          from CEQA under the proposed amendments:  (1) approximately 
          90 land mobile radio system 180-foot towers with several 
          antennas and microwave dishes; and (2) approximately 255 
          long-term evolution broadband mobile data system 70-foot 
          tapered monopoles with antennas and microwave dishes.
