SUMMARY : Makes an employee of a school district that is not
within the jurisdiction of the county board of education
eligible to be a member of that county board of education.
EXISTING LAW :
1)Prohibits an employee of a local agency, including local
education agencies, from being a member of the governing board
or legislative body of that agency.
2)Prohibits a county superintendent of schools, any member of
his or her staff, or any employee of a school district from
being a member of the county board of education.
3)Prohibits a local agency officer (defined to include governing
board members) from engaging in any employment that is
inconsistent, incompatible, in conflict with, or inimical to
his or her duties as a local agency officer (incompatibility
of office doctrine).
COMMENTS : As introduced, this bill would have allowed any
employee of a school district to be eligible to be a member of
any county board of education. In order to avoid potential
conflicts of interest and violations of the incompatibility of
office doctrine, committee amendments restrict eligibility to
employees of school districts that are not within the
jurisdiction of the county board of education. This is
consistent with existing law, which allows school employees to

serve on the governing boards of school districts other than the
district in which they are employed.
