   An act to add Section  240   85310  to
the Water Code, relating to water resources.


	LEGISLATIVE COUNSEL'S DIGEST


   AB 1871, as amended, Logue.  Water supplies: drought
preparedness.   Delta Stewardship Council: Delta plan.
 
   Existing law, the Sacramento-San Joaquin Delta Reform Act of 2009,
establishes the Delta Stewardship Council (council) as an
independent agency of the state. Existing law requires the council,
on or before January 1, 2012, to develop, adopt, and commence
implementation of a comprehensive management plan for the Delta
(Delta Plan), as specified. Existing law requires the council to
consider for inclusion in the Delta Plan a multispecies conservation
plan called the Bay Delta Conservation Plan (BDCP), and requires the
incorporation of the BDCP into the Delta Plan if the BDCP meets
certain requirements.  
   This bill would prohibit the council from adopting a final version
of the Delta Plan until the completion of the BDCP.  
   Existing law authorizes the Department of Water Resources to
operate the State Water Project and to undertake various other
functions relating to the water resources of the state. 

   This bill would require the department to prepare and submit to
the appropriate committees of the Legislature a report that includes
recommendations relating to drought preparedness and to conduct an
annual survey of public and private water suppliers relating to water
supply reliability in the event of a drought. 
   Vote: majority. Appropriation: no. Fiscal committee: yes.

THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:

   SECTION 1.    Section 85310 is added to the 
 Water Code   , to read:  
   85310.  Notwithstanding any other law, the council shall not adopt
a final version of the Delta Plan until the completion of the Bay
Delta Conservation Plan.  
  SECTION 1.    Section 240 is added to the Water
Code, to read:
   240.  The department shall do both of the following:
   (a) Notwithstanding Section 10231.5 of the Government Code,
prepare and submit to the appropriate committees of the Legislature a
report that includes recommendations relating to drought
preparedness.
   (b) Conduct an annual survey relating to the ability of each
public and private water supplier, including water corporations,
serving more than 1,000 residential connections to provide adequate
and reliable water service in the event of a drought.
   (c) A report to be submitted pursuant to subdivision (a) shall be
submitted in compliance with Section 9795 of the Government Code.
