          SUBJECT  :   Physical education: California Interscholastic 
          Federation: report.

           SUMMARY  :   Requires the California Interscholastic Federation 
          (CIF), when it reports to the Legislature and the Governor on 
          its evaluation and accountability activities, to transmit an 
          electronic copy of the report to specified policy committees of 
          the Legislature.  Specifically,  this bill  provides that when the 
          CIF reports to the Legislature and the Governor on its 
          evaluation and accountability activities undertaken, as 
          specified, on or by January 1, 2016, that an electronic copy of 
          the report shall also be transmitted to the Assembly Committee 
          on Arts, Entertainment, Sports, Tourism and Internet Media 
          (AEST&IM), the Assembly Committee on Education, and the Senate 
          Committee on Education.

           EXISTING LAW  : 

          1)Establishes the CIF as a voluntary organization responsible 
            for administering high school interscholastic athletics and 
            sunsets this authorization on January 1, 2017.  

          2)Requires the CIF to report to the Legislature and Governor by 
            January 1, 2016, on several specified goals and objectives, 
            such as effectiveness of the governance structure, gender 
            equity, health and safety, and economic viability.  

          3)Authorizes the California Department of Education (CDE) to 
            determine if the policies of school districts and the CIF are 
            in compliance with state and federal laws, as specified.

           Background: CIF and Oversight Hearing of the AEST&IM Committee  :

          The CIF is an association of public, private and parochial 
          secondary schools which was formally established in 1914.  The 
          CIF is authorized by state statute and is responsible for 
          administering all high school athletic programs; including 
          establishing rules for participation.

          In 1981, the Legislature delegated state oversight of high 
          school athletics to local school district governing boards. That 
          same legislation recognized the authority of the CIF, and 
          allowed the local districts to join such associations. 

          According to the CIF website, currently, more than 1,372 public 
          and private high schools in California compete in the wide range 
          of athletic activities administered by the CIF and organized 
          under the direction of local school boards.  In total, over 
          700,000 girls and boys throughout the state compete in more than 
          30 sports each year.

          In 2008, the AEST&IM Committee held an Informational Hearing 
          into the state oversight of the CIF, and the organization's 
          operation of state athletic competitions.

          The Committee learned that the assignment to the CIF of 
          administering interscholastic athletic activities in California 
          secondary schools is subject to a five year sunset.  Each five 
          year renewal period, according to the Education Code, is to be 
          accompanied by an Evaluation and Accountability Goals and 
          Activities Report to the Legislature and Governor.  This sunset 
          review and report, in large part, provide the only meaningful 
          oversight which the state exercises over the CIF. 

          One of the recommendations coming out of the AEST&IM 
          Informational Hearing was to have the CIF distribute their 
          Evaluation and Accountability Goals and Activities Report to the 
          Assembly and Senate Committees on Education, as well as the 
          AEST&IM Committee.

          In response to AB 2095, the CIF notes that "the governance body 
          of the CIF is dedicated to transparency in all of its activities 
          and strives to communicate clearly to parents, students, 
          administrators, and state officials regarding issues affecting 
          interscholastic athletics." Accordingly, they would be pleased

          and willing to send an electronic copy of the report to the 
          AEST&IM Committee, and therefore, they believe legislation is 
          not necessary.

           Author's Statement and Support  :

          According to the author, "Theoretically, state law allows for 
          the Governor and Legislature to provide guidance and oversight 
          of the CIF, by requiring a 5 year sunset review and an 
          Evaluation and Accountability Goals and Activities Report.  
          However, the distribution of the report makes meaningful 
          oversight difficult, as the Education Code does not state to 
          whom the report must be given.  

          "Current practice of the CIF is to deliver copies to the Speaker 
          of the Assembly and President Pro Tempore of the Senate, along 
          with the Minority Leaders of each house. Testimony in the 2008 
          Informational Hearing of the AEST&IM Committee determined that 
          better legislative oversight would be provided if the interested 
          policy committees were also to be given copies of the report. AB 
          2095 would implement the Committee's recommendation for 
          distribution of the report, without incurring additional costs 
          burdens on the CIF, by requiring an electronic copy of the 
          report be distributed to the interested policy committees." 

          The California Association for Health, Physical Education, 
          Recreation and Dance (CAHPERD), states in support, "The vital 
          work CIF does to ensure gender equity will be further enhanced 
          with increased public input." They add, "CIF's strong leadership 
          role has resulted in coaching training programs that have made 
          significant contributions to high school athletic programs.  The 
          increased reporting requirements in AB 2095 will verify and 
          ensure the continuance of quality training for coaches as the 
          legislature will be informed of issues that demonstrate need for 
          inclusion in subsequent coaching training programs."



           Prior Related Legislation :

          SB 107 (Price) Chapter 230, Statutes of 2011; extended the 
          sunset for the CIF from January 1, 2012 to January 1 2017 and, 
          required that the CIF report to the Legislature and Governor by 
          January 1, 2016 on several specified goals and objectives.

          SB 562 (Torlakson), Chapter 301, Statutes of 2006; among other 
          things, extended the sunset on CIF statutes from January 1, 
          2007, to January 1, 2012.  
                     
          SB 225 (Kuehl), Chapter 889, Statutes of 2001; among other 
          things, extended the sunset date from January 1, 2001, to 
          January 1, 2007.
