SUMMARY
This bill deletes the January 1, 2013 sunset date on provisions
requiring the California State University (CSU) Board of
Trustees to adopt, amend or repeal regulations using a specified
process in lieu of the process set forth in the Administrative
Procedures Act (APA).
FISCAL EFFECT
Ongoing administrative cost savings to the CSU for continued use
of the existing process for adopting regulations, which do not
require outside review by the Office of Administrative Law (OAL)
pursuant to the APA.
COMMENTS
Purpose . AB 3132 (Firestone)/Chapter 938 of 1996 allowed the CSU
to streamline many administrative operations, including
promulgating regulations by requiring the CSU Office of General
Counsel to perform a review similar to that performed by OAL
under the APA. This authority was initially granted for five
years, and has since been extended several times, most recently
by AB 262 (Coto)/Chapter 679 of 2007. This bill, sponsored by
CSU, removes the January 1, 2013 sunset provision. According to
the author, CSU has received no complaints regarding the current
process despite enacting, repealing or modifying 68 groups of
regulations.
