SUBJECT : Joint exercise of powers.
SUMMARY : Repeals an obsolete section of law related to joint
powers agreements.
EXISTING LAW :
1)Provides that in addition to other powers, any agency,
commission, or board provided for by a joint powers agreement
between an irrigation district and a city, is authorized to
issue revenue bonds to pay the cost and expense of acquiring,
constructing, improving, and financing a project for specified
purposes.
2)Makes this provision inoperative after December 31, 1973,
except as specified.
FISCAL EFFECT : None
COMMENTS :
1)This author-sponsored measure aims to update the code related
to the Joint Exercise of Powers Act (the Act) by deleting an
obsolete provision that granted revenue bond authority to a
joint powers agreement between a city and an irrigation
district for certain capital projects. That provision expired
by its own terms in 1973, but the statute was never removed
from the books. According to the author, "AB 2183 simply seeks
to clean up the Government Code by eliminating this code
section, which is no longer operable."
2)Support Arguments : This bill represents a first step in a
larger process of cleaning up the Act, thereby reducing the
number of useless laws in the California codes.
