    An act to amend Section 19570 of the Government Code,
relating to public employment.   An act to add and
repeal Article 7 (commencing with Section 79220) of Chapter 9 of Part
48 of Division 7 of Title 3 of the Education Code, relating to
community colleges.

 Public employment: adverse actions.   Community
colleges: San Mateo Innovation Center Pilot Program.  
   Existing law establishes the California Community Colleges, under
the administration of the Board of Governors of the California
Community Colleges, as one of the segments of public postsecondary
education in this state. Existing law establishes community college
districts, administered by a governing board, throughout the state,
and authorizes these districts to provide instruction to students at
the community college campuses maintained by the districts. 

   This bill would authorize the San Mateo County Community College
District to partner with the Economic Development and Growth
Enterprise to establish the San Mateo Innovation Center Pilot Program
to accomplish specified objectives relating to business development
and job creation. The bill would provide that the pilot program only
would be operative if the Legislature appropriates funds expressly
for purposes of this article, or if sufficient private funding is
received, whichever comes first. The bill would repeal the pilot
program on January 1, 2016.  
   This bill would make legislative findings and declarations as to
the necessity of a special statute for the San Mateo County Community
College District.  
   Existing law prescribes procedures for taking adverse action
against state employees, other than managerial employees. Existing
law defines "adverse action" for the purposes of those procedures.
 
   This bill would make a technical, nonsubstantive change to that
provision. 
   Vote: majority. Appropriation: no. Fiscal committee: no.
State-mandated local program: no.


THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:

   SECTION 1.    Article 7 (commencing with Section
79220) is added to Chapter 9 of Part 48 of   Division 7 of
Title 3 of the   Education Code   , to read: 


      Article 7.  San Mateo Innovation Center Pilot Program


   79220.  The San Mateo County Community College District may
partner with the Economic Development and Growth Enterprise to
establish the San Mateo Innovation Center Pilot Program to accomplish
all of the following objectives:
   (a) Promote business development and job creation by helping early
stage business ventures with new ideas to either find early stage
funding or to reach the point of operating stability.
   (b) Leverage the underutilized infrastructure and nascent
entrepreneurship programs of the community college system to sponsor
programs that encourage and reward creativity, collaboration, and
innovation.
   (c) Recruit and coordinate businesses and investors from the local
community to provide funding, sponsorships, and internships.
   79221.  This article shall be operative only if the Legislature
appropriates funds expressly for purposes of this article, or if
sufficient private funding is received, whichever comes first.
   79222.  This article shall remain in effect only until January 1,
2016, and as of that date is repealed, unless a later enacted
statute, that is enacted before January 1, 2016, deletes or extends
that date. 
   SEC. 2.    The Legislature finds and declares that a
special law is necessary and that a general law cannot be made
applicable within the meaning of Section 16 of Article IV of the
California Constitution because of the need to create a temporary
pilot program to promote business development and job creation in a
community college district that offers a business friendly
environment and special entrepreneurial curricula.  
  SECTION 1.    Section 19570 of the Government Code
is amended to read:
   19570.  As used in this article, "adverse action" means dismissal,
demotion, suspension, or other disciplinary action. This article
shall not apply to any adverse action affecting managerial employees
subject to Article 2 (commencing with Section 19590), except as
provided in Sections 19590.5, 19592, and 19592.2.
