SUBJECT : Ronald Reagan Memorial; State Capitol

DIGEST : This bill would authorize the Ronald Reagan
Centennial Capitol Foundation, in consultation with the
Department of General Services (DGS) and a specifically
created committee, to construct and maintain a memorial to
Ronald Reagan in the State Capitol Building Annex. It would
require that the planning, construction, and maintenance of
the memorial be funded with private donations through the
Ronald Reagan Centennial Capitol Foundation. It would
prohibit construction of the memorial until the Department of
Finance has determined that sufficient private funding is
available to construct and maintain the memorial.
ANALYSIS : Specifically, this bill:
1. Establishes the Ronald Reagan Memorial Review
Committee (Committee) consisting of the following: the
director; the State Historic Preservation Officer; a
member of the Assembly appointed by the Speaker of the
Assembly; a member of the Senate appointed by the Senate
Committee on Rules. The Committee shall consult with the

Foundation to identify an appropriate location for the
memorial in the State Capitol Building Annex and review a
memorial design.
2. The Department of General Services (DGS) in
consultation with the Foundation shall accomplish the
following goals: review the preliminary design plans to
identify potential maintenance and safety concerns;
ensure compliance with the federal Americans with
Disabilities Act of 1990; review and approval of proper
CEQA documents; review final construction documents;
prepare the right of entry permit outlining the final
area of work, final construction documents, construction
plans, the contractor hired to perform the work,
insurance, bonding, provisions for damage to state
property, and inspection requirements. Prepare the
maintenance agreement; inspect the construction performed
by the contractor selected by the Foundation.
3. If the Foundation undertakes responsibility to
construct a memorial under this section, it shall, in
consultation with DGS, establish a schedule for the
design, construction, and dedication of the memorial,
implement procedures to solicit designs for the memorial,
and devise a selection process for the choice of the
design.
4. If the Foundation undertakes responsibility to
construct a memorial under this section, it shall not
begin construction of the memorial until DOF has
determined that sufficient private funding is available
to construct and maintain the memorial.
5. The planning, construction, and maintenance of the
memorial shall be funded exclusively through private
donations to the Ronald Reagan Centennial Capitol
Foundation.
COMMENTS :
Each Governor of the State of California has a portrait on
display in the State Capitol building.
This bill does not specify the type of memorial - statue, wall
plaque, tribute similar to the tributes to the California
Highway Patrol, the California National Guard, the California
Firefighters, or the Medal of Valor recipients, etc., located

on the first floor of the annex.
The Committee on Rules may wish to consider requiring the
approval and adoption of the memorial plan by the Joint
Committee on Rules, and only if the Joint Committee on Rules
and the Department of Finance has determined sufficient
private funding is available to construct and maintain the
memorial.
The author intends to offer an amendment to AB 2358 to clarify
the reference to the director in the composition of the
Committee refers to the Director of DGS.
FISCAL IMPACT :
Minor, absorbable costs to DGS and DOF to consult with the
Foundation and review legal and financial requirements.
