SUMMARY
This bill increases, from $150 to $275, the amount that must be
deposited with a public entity for each day that one of the
public entity's employees, as specified, is required to be in
court in response to a subpoena in a civil matter.
FISCAL EFFECT
No direct fiscal impact, as the bill only modifies the amount of
the deposit. Pursuant to current law, differences between actual
costs for an employee's appearance and any amounts deposited
must be settled up by the public entity and the party who
requested the subpoena.
COMMENTS
Purpose . Current law, first enacted in 1963, requires, if a
peace officer, firefighter, state employee, trial court
employee, or county employee is subpoenaed in a civil matter,
the party requesting the subpoena must deposit $150 with the
employer for each day the employee must be in court. The deposit
amount was initially established at $25 per day, and through
subsequent legislation was raised incrementally to $150 in 1986.
This bill, therefore, provides the first increase in the deposit
amount in 26 years.
