SUMMARY : Deletes the sunset date of January 1, 2013, for
Williamson Act (Act) lot line adjustments. A lot line
adjustment is allowed if it is agreed upon by a city or county
and a landowner, to rescind an Act contract and simultaneously
enter into a new contract to facilitate lot line adjustments.
The Senate Amendments delete the repeal date on an authorization
for Act lot line adjustments.
EXISTING LAW authorizes owners of land subject to the Act to
seek approval for lot line adjustments without having to utilize
the Act's nonrenewal or cancellation provisions and pay
cancellation fees. This authorization will sunset on January 1,
2013.
AS PASSED BY THE ASSEMBLY , this bill extended the authorization,
from January 1, 2013, to January 1, 2017, when agreed upon by a
city or county and a landowner, to rescind an Act contract and
simultaneously enter into a new contract to facilitate lot line
adjustments. This bill was substantially similar to the version
approved by the Senate.
FISCAL EFFECT : None. This bill is keyed non-fiscal by the
Legislative Counsel.
COMMENTS : The Act conserves agricultural and open space land
under a three-part system that involves voluntary contracts that
enforceably restrict land uses, reduce property tax assessments
and, state subventions to make up for the lost revenues. Land
subject to an Act contract cannot be subdivided into parcels
that are too small to sustain their agricultural use.

The provisions of this bill were originally enacted in 1990 with
the intention of validating and opening rules for lot line
adjustments involving the Act's contract and non-contract lands,
when some of the land was being removed from the Act, and when
there is no other existing statutory authority. In 1999, these
provisions were changed to include all Act lands going through
lot line adjustments. The Act lot line adjustment's sunset has
been extended four times since 2004. These provisions will
expire on January 1, 2013.
